On Wednesday, April 30, 2025, at approximately 2152 hours, I was dispatched to 300 N Dixie Ave (Waffle House) in reference to a male being disorderly and refusing to leave the business.

I arrived on scene and through the window of the business, I observed a male, later identified as Michael Bearden, yelling at the workers, throwing his hands in the air, and kicking the stores “wet floor sign”.

I entered the business and observed the male walking towards customers who were sitting in a booth. I identified myself as a police officer and escorted Mr. Bearden outside. I then spoke to the caller who stated the male was outside the business yelling racial slurs at the customers inside. The caller stated Mr. Bearden entered the business and continued to yell racial slurs at customers.

When Mr. Bearden was told to leave, Mr. Bearden refused. When The Caller advised Mr. Bearden that she was calling the police, Mr. Bearden stated “Ill fight them too”. The Caller stated that Mr. Bearden acted in this manner the pervious night and was told not to come back to the business.

The Caller requested that Mr. Bearden be criminally trespassed from the business. I issued Mr. Bearden a Criminal Trespass Warning per The Caller request. I arrested Mr. Bearden by placing him into hand cuffs behind his back, double locking, and checking for proper fit. Mr. Bearden was searched for contraband and none was found. I placed Mr. Bearden in the rear seat of my department issued, marked patrol car. My patrol car had been searched prior to and after each transport with no contraband found.

I transported Mr. Bearden to the Bartow County jail where he was turned over to jail staff. I searched my patrol car for contraband and found none. I later secured arrest warrants for Disorderly Conduct (CE-0173541).
