On March 20th, 2026, at approximately 1729 hours, Deputy Brand and I were dispatched to [300 BLOCK] Penn Station Way in Cartersville in reference to a domestic disturbance.

Upon arrival, I met with multiple females and two males who were yelling at each other from across the street. I approached one of the males, who was later identified as Jacquez Fountain, and asked him what was going on, but he would not tell me.

Jacquez then approached Timothy Smith, and the two began arguing. Deputy Brand broke up the argument for a moment, and I asked Timothy what was going on. He told me nothing was going on, and he had just gotten home from work. Timothy also said he did not know Jacquez.

Timothy approached Jacquez and began arguing with him again while Deputy Brand was trying to keep Jacquez away from Timothy. Timothy and Jacquez began yelling at each other again, and Jacquez said, “I’m gonna beat the sh*t out of him,” and “I’m gonna knock his a*s out”. Timothy said he was gonna “beat his a*s,” and they both said, “Come on, let’s go, let’s do it!” To prevent the situation from escalating further, I detained Timothy, and Deputy Brand detained Jacquez. While I was attempting to place Timothy in handcuffs, he was still yelling at Jacquez, and he pulled away from me slightly. Jacquez was also pulling away from Deputy Brand in an attempt to fight Timothy.

I performed a Terry pat search on Timothy for weapons and placed him in my patrol car, and Deputy Brand placed Jacquez in his patrol car so we could figure out exactly what was going on without them fighting each other.

After Timothy and Jacquez were placed into our patrol cars, two females on one side of the street and one female on the other side were screaming at each other. I spoke with [VICTIM #1], who told me that she was parked in front of [VICTIM #2]’s residence in her Jeep Cherokee (bearing Ga tag [REDACTED]), with [VICTIM #2] in the car, when Timothy approached her vehicle with a gun and waved it in multiple directions. [VICTIM #1] said she called her boyfriend, Jacquez, because she was scared of Timothy, and Jaquez showed up approximately 2 minutes before I arrived on the scene.

[VICTIM #2] had the same story as [VICTIM #1], as she was in the car with her, and she said she was traumatized.

Deputy Brand spoke with [WITNESS #1], Timothy’s mother, who said she felt that [VICTIM #2] and [VICTIM #1] were watching her son, Timothy, from the car they were in. [WITNESS #1] said Timothy felt like they were casing him. [WITNESS #1] said Timothy went up to their car and asked them to leave, and that he did not have a gun in his hand when he approached the vehicle.

Deputy Brand said Jacquez told him that he didn’t have a single clue about what was going on. In a spontaneous utterance, Jacquez stated, “I told him to put the gun down and fight.” Jacquez said he never had a gun.

[WITNESS #1] provided Deputy Brand with her doorbell camera footage, which showed Timothy racking the slide of his handgun (a Glock 43x 9mm, serial number BPAV484) and walking toward where [VICTIM #1] and [VICTIM #2] were parked. [WITNESS #1] gave Deputy Brand and me written permission to enter the house and find Timothy’s handgun. Deputy Brand retrieved the Glock 43x from underneath a pillow in one of the upstairs bedrooms in [WITNESS #1]’s house. Timothy’s gun had 10 rounds in the magazine; the chamber was empty.

Timothy and Jacquez were transported to the Bartow County Jail. [WITNESS #1] uploaded the video evidence to CoreForce, and Timothy’s gun was submitted as evidence.

I obtained three warrants for Timothy. Two counts of aggravated assault because he used his Glock 43x offensively against [VICTIM #1] and [VICTIM #2], which was likely to result in serious bodily injury. [VICTIM #2] and [VICTIM #1] feared for their life as Timothy racked the slide of his handgun while walking toward them. One count of disorderly conduct because Timothy used fighting words against Jacquez, he attempted to engage in an altercation with Jacquez, and he pulled away from me in an attempt to cause harm to Jacquez.

I obtained one warrant for Disorderly Conduct for Jacquez, as he also used fighting words against Timothy, he attempted to engage in an altercation with Timothy, and he also pulled away from Deputy Brand in an attempt to cause harm to Timothy.
