At about 11:43 am on this date, I was at the Friendly Express #96 store on Old GA. 259, in the process of serving a civil paper to [REDACTED], whom I had encountered in the parking lot when I stopped for soda. As I was by my patrol truck filling out the paper, I heard the roar of a four wheeler engine and tires, as I looked towards the Satilla Grocery parkign lot and saw a red four wheeler coming out towards Old Hwy. 259.
The man on the machine had a full gray beard. He was looking right at me as he came up to the stop sign and he was “dancing” on the saddle. He came to a stop and was looking at me, then he started “dancing” again, yet I did not hear any music from anywhere. This unusual behavior made me to think he was “on something”, that he was drunk or tweaking on drugs.
He then took off across the highway into the parking lot of the Snak Shak Business (which had patrons on the front porch) and sped across there at an unreasonable high speed, almost as if he were trying to provoke an officer to go after him or that he was just intent on getting away from me before I had any chance to start after him.
I did not recognize the man right then, but thought he looked familiar. He had been wearing a ballcap, black jacket, and mirror sunglasses. I finished serviing the civil, then I started to go out eastbound on GA. Hwy. 520. As I passed by the Friendly Express #94 store, I spotted this same man on the same four wheeler, as he was coming out on the pavement of the Hwy. 110, in a way like he had passed a car on the right, cause he was just over to the front right front end of the car.
I made a U turn to go back and talk to him, to tell him to stay off the pavement and to see if he had any other signs of possible intoxication. He saw me in the turning lane, as I was going to turn onto 110 to stop and speak to him out of my driver’s door window. I quickly got my phone on video to try to video how he was acting, as he did a little “dance” move and then drove across the intersection in front of me, going down Hawthorn, accelerating hard. I turned down Hawthorne, and saw him going over the tracks. He turned his head to look back at me, and seeing me coming, he ran th stop sign that is at Connie Ln., and took off eastbound on Connie Ln.
I sped up to catch up to him, and initiated a traffic stop by turning on blue lights and continuous sirens. The man looked back at me, then he sped up and started doing fishtails on purpose. When we entered the Hunting Club Rd. off the end of Connie Ln., he turned and drove out into the brush area that was burned over last month. He was going unsafely fast, as he was going over the rows and humps, I saw that the jolts were bouncing him up off the saddle and he went out of sight but I wasn’t sure that he hadn’t rolled it, so I stopped and got out to walk out there and check.
As I was walking out to where I last saw him, I heard the machine from about 100 yards farther up. I went back to my truck and drove on east about a 150 yards, where I saw the fresh tracks from him driving back out on the main dirt road, then after another 100 yards, the tracks went into a firebreak plowed to the north. I heard the sound of the ATV engine that now sounded like it was back west of me.
When I drove back out to Connie Ln., I saw the fresh spin marks where he had skidded back out from the woods on the north side to go back west on Connie Ln.. I radioed Sgt. Bennett that I thought the guy would go back towards the river, but Sgt. Bennett had just came from there, and had not seen it, so it must have gone up Atkinson Rd.. I had got another call to check on, so I went enroute to it at Bobwhite Loop. I sent Sgt. Bennett a screen shot of the violator on the four wheeler as he crossed Hwy. 520 and another of the back view as he had been speeding away on Connie Ln..
While I was on Bobwhite Loop for the other call, I heard Sgt. Bennett radio dispatch that he was out at a residence on Coffee County Club Rd. with the four wheeler. I went enroute to there. While I was going, I heard Sgt. Bennett radio that he had to use the taser and O.C. to get the violator detained.
When I arrived there, I found the offender getting his face rinsed by his sister in the yard. I saw that he was the same man I had seen, except he had taken off his BDU pants and the black jacket. I saw the four wheeler was the same one I had been after. At that time, up close and with his sunglasses off, I did recognize the offender from prior encounters years ago. He acknowledged that it had been him that I was behind, but he claimed he didn’t know that I was pulling him over, that he was supposedly just driving around fast thru the woods.
He did state that he had looked directly at me when he came by me at the store on Hwy. 259 and also that he had looked back and saw me coming after him on Hawthorn Rd.. I told him that his unusual demeanor and excessive speed had been my cause for wanting to talk to him, that I suspected he was “on something”. He agreed that he could see how an officer could think that.
I saw his eyes were bloodshot, but I also realized that he had been sprayed with O.C., so I asked him to take an also sensor test. He blew in to the device. I smelled the odor of alcoholic beverage on his breath whe he blew. He tested positive for the presence of alcohol at a failing level (0.106). I gave him an HGN test. He said that he could only open one eye at a time due to the O.C.. I did see very distinct nystagmus in both of his eyes; there was lack of smooth pursuit, on-set prior to 45 degrees, and jerking at maximum deviation. I asked if he had done anything besides alcohol and he replied that he had not.
I got the VIN from the four wheeler and ran the routine check for stolen. Sgt. Bennett ran the offender’s driver’s license; it showed active suspension for a prior “no insurance” conviction. The offender admitted that he was aware that he got a suspension for a ticket he paid.
I told the offender that he was under arrest for fleeing and DUI, as well as Sgt. Bennett’s case for obstruction. I promptly read the offender the implied consent notice from the card. When I requested him to submit to a state blood test, he replied that he would not submit to that. He commented to the effect of, “yall know Im under the influence, I know Im under the influence, it would just be a waste of time..” (To do the blood test). I explained to him that it wasn’t a waste of time, but he still refused.
The ATV was left at his sister’s yard. I took the offender to our jail, where I issued him citations for the three charges under his offender tab. I gave him written warnings for operating the off road vehicle on the property of others and the public roads, as well as a warning for his driver’s license issue.
