On Wednesday July 26, 2023, at 2005 hours, I, Lt. Eric McCants was patrolling Highway 56 North when I noticed a vehicle (2007 Blue Chevrolet Colorado Ga Tag# [REDACTED]) with a malfunctioning left brake light.
I got behind the vehicle and confirmed that one of the brake lights on the left side was not working. I conducted a traffic stop on the vehicle on Highway 56 North at Spring Branch Church Road. I approached the vehicle on the passenger side and noticed that windows on the vehicle appeared to be very dark as well. Also, I detected the strong odor of marijuana coming from inside of the vehicle.
I spoke to Mr. Nathan Black (driver/ offender) and informed him the reason for the stop. Mr. Black stated that he had just repaired the brake light and that it might have burnt out again. I had Mr. Black step out of the vehicle and step to the rear so that I could speak to him further. After completing an inquiry through GCIC, I asked Mr. Black was there any marijuana in the vehicle. Mr. Black stated that there was half of a blunt inside of the vehicle.
I had Mr. Black lean against my vehicle while I got Mr. Patrick Abbey (passenger/ offender) and Ms. [REDACTED] (juvenile/ other) out of the vehicle. I asked both subjects was there anything in the vehicle that I need to know about and Mr. Black replied that there was a red jar inside of the vehicle that contained marijuana.
Deputy Tyler May arrived on scene and stood with the individuals as I searched the vehicle. Lastly, as I was about to start searching the vehicle, Mr. Black informed me that there was a firearm in the vehicle and it belonged to him.
I searched the vehicle and found a black and red bag on top of the center console. Inside of the bag in one of the pockets was a firearm (Ruger 9mm SN# 386-10372) loaded with a magazine that contained 13 rounds. Additionally, in the other pocket of the bag were two 9mm magazines. One of the magazines contained 15 rounds and the other contained 19 rounds.
I continued searching and found a clear container inside of the center console. Inside of the clear container was a clear plastic bag with approximately 0.9 grams of methamphetamine. After locating the narcotics I detained both subjects.
I finished searching the vehicle and found half of a marijuana blunt that was approximately 0.63 grams in the driver side door pocket and the red jar stuffed under Mr. Abbey’s seat containing about 2 grams of marijuana. Lastly, I tested the driver front window with my tint meter and it had 5% tint on it.
I field-tested the marijuana and methamphetamine and both yielded positive results.
I seized the firearm, magazines, ammunition, methamphetamine, and marijuana at the time of stop. The firearm, magazines, and ammunition were placed in the evidence locker at the Burke County Sheriff’s Office under property receipt# 07766.
The marijuana was placed in the drug safe at the Burke County Sheriff’s Office under property receipt# 07765. The methamphetamine was placed in the drug safe at the Burke County Sheriff’s Office under property receipt# 07764.
I read Mr. Black and Mr. Abbey Miranda Warning and they both stated that did not want to speak to me.
I informed both individuals that they were under arrest. I had Mr. Abbey to make arrangements to have Ms. [REDACTED] picked up. Additionally, Mr. Black was able to make a phone call to Ms. [REDACTED] and she came to our location and the vehicle was turned over to her. Lastly, Ms. [REDACTED] was released to Ms. [REDACTED] without incident.
Both individuals were transported to the Burke County Detention Center. Mr. Black was charged the having the inoperable Brake Light, Tint Violation, Marijuana Possession, Methamphetamine Possession, and Possession of a Firearm during the Commission of a Crime.
Mr. Abbey was charged with Marijuana Possession and Methamphetamine Possession.
