On 5/17/2026 at 04:16 hours, I responded to [300 BLOCK] Foster Street (Flagship Apartments) in reference to a male in a Toyota Camry (GA# [REDACTED]) parked crookedly in the back of the apartment complex and asleep behind the steering wheel. Upon my arrival, I observed the vehicle parked crookedly, taking up two different parking spots. The driver, Brandon Price (offender/arrested), was awake at the time of my arrival.
I instructed Brandon to roll down the window, in which he began to move very slowly and reach for the blinker and his windshield wipers. As Brandon did not understand my instructions, I advised my partner to block his vehicle in to prevent his escape as I suspected that the male was under the influence of alcohol. I repeated the instructions to Brandon in which he eventually rolled down the window.
Brandon’s speech was very quiet and slurred upon initial contact. I could also notice that his face appeared to be flushed and his eyes were glassy. He stated to me that he lived at the apartment complex and that he was only sitting in the parking lot. He later stated that he got to his parking spot a few hours prior and meant to go inside before he fell asleep in his car. While trying to discern the reason for him falling asleep behind the wheel, his story did not seem to make sense, nor did his time frames line up. I requested Brandon to exit the vehicle and continue our conversation at the front of my patrol vehicle.
After bringing Brandon to the front of my patrol vehicle, he told me that he had been in the parking lot for a few hours after coming back from The Foundry after “celebrating Saturday night”. He stated that he had no alcoholic beverages that night. I asked Brandon if he would be okay going through Standardized Field Sobriety, in which he agreed to do so.
Upon conducting Standardized Field Sobriety Testing I observed the following clues:
Horizontal Gaze Nystagmus: 6/6 clues (4 clues indicate impairment)
Walk and Turn: 5/8 clues (2 clues indicate impairment)
One Leg Stand: Did not evaluate. It should be noted that Brandon stated he understood the instructions and proceeded to do another Walk and Turn evaluation again.
I asked Brandon if he was comfortable providing a breath sample, in which he declined.
Brandon was placed in handcuffs, checked for fit, double-locked, and placed in the back of my patrol vehicle.
I read Brandon Implied Consent Notice for Suspects Age 21 or Over, in which he refused the state administered chemical test of his blood.
Inside the vehicle we were able to locate a six-pack of Jack Daniel’s cocktails missing one bottle.
Brandon was transported to the Carroll County Jail where he was signed the administrative license suspension.
It should be noted that officers were able to locate Brandon’s vehicle on Flock traveling on the opposite side of town than what he stated around 03:00 hours. Brandon denied any knowledge of this.
