On Tuesday May 12,2026 Cpl Cavender got out with a vehicle that was stopped in the middle of the roadway on Northside Dr. Cpl Cavender asked for another unit due to the driver passed out behind the wheel and the vehicle still in gear with the driver having his foot on the brake.
I arrived and placed my Marked Patrol car in front of the pickup truck which was a Nissan Titan White in color with Georgia Tag [REDACTED]. I went to the driver side, and I also noticed the truck was still in gear and the driver passed out. I noticed the driver had his foot on the brake as well. I checked the driver door, and the door was unlocked and I was able to open the door and slam the truck into park. The inside of the truck had a very strong alcoholic beverage odor inside the truck. I attempted to wake the driver, and he moved his hand towards the gear shift, so I cut the engine off and took the keys out and laid them on top of the truck.
The driver woke up and was identified as Dwight Nixon of [500 BLOCK] Bagwell Rd Carrollton, Ga. I asked Dwight for his driver’s license, and he was mumbling and stated that [REDACTED] had them I asked him to exit the truck and Dwight was very unstable on his feet and could hardly walk. Once Dwight got out I again asked for his driver’s license and he reached in his front pocket and pulled out his wallet but could not hand me the license. I asked Dwight where he was coming from and asked if he knew where he was. Dwight said he was at work and headed home. I asked if he knew where he was and he said on the side of the road because he got tired and moved over. I told Dwight he was sitting in the middle of the roadway and was passed out.
I asked Dwight how much he had to drink and he said 2 beers but could not say what kind nor how much he had drunk. I asked Dwight to walk to the front of CPL Cavender’s marked patrol car which was [REDACTED]. As Dwight exited the vehicle I noticed several open small bottles in the back seat. I checked the bottles and there were 3 Jim Beam Peach and 1 Dill Pickle shot all were empty. Due to the fact my patrol car was in front of Dwight’s truck I had Dwight stand in front of CPL Cavender’s car.
As I was talking to Dwight, I noticed that Dwight had blood shot watery eyes and very slurred speech. As I was talking with Dwight, I could smell a very strong odor of alcoholic beverage emitting from Dwight’s breath and it had a very sweet smell to it. I asked Dwight if he would be willing to perform Standardized Field Sobriety Test and Dwight gave verbal YES. Below are my findings:
Dwight advised that he would be willing to submit to SFST’s to ensure he was fit to operate a motor vehicle. The following are my observations of Dwight during the subsequently administered SFST’s:
I then medical cleared Dwight by making sure they had no recent head injuries and had no physical limitations that would limit him from walking, turning, or standing on one leg.
HGN / VGN:
I observed both of Dwight’s pupils to be of equal size and observed no resting nystagmus in either eye. I observed equal tracking in both eyes.
The following clues were observed for a total of 6 out of 6 possible clues.
Lack of Smooth Pursuit –Observed
Distinct and Sustained Nystagmus at Maximum Deviation – Observed
Onset of Nystagmus Prior to 45 Degrees – Observed
Vertical Nystagmus – Not Observed
Additional observations of Dwight during this evaluation: Dwight was swaying the entire time and I had to tell Dwight many times to keep his head still and follow the stimulus which Dwight had a hard time.
The Walk and Turn:
Additional observations of Dwight during this evaluation: Dwight said at first he was fine and once I asked about the walk and turned Dwight said he had bad knees and no cartilage in his knees and they hurt all the time.
The One Leg Stand:
Additional observations of Dwight during this evaluation: Dwight said at first he was fine and once I asked about the one leg stand Dwight said he had bad knees and no cartilage in his knees and they hurt all the time.
PBT: (Portal Breath Test)
Dwight agreed to conduct the PBT. The PBT indicated a positive presence of alcohol on Dwight’s breath, indicating a BrAC of 0.231 grams.
Based upon my Knowledge, Experience, Training and contact with the driver Dwight, I determined that he was under the influence of alcohol to a point that it was unsafe for him to operate a motor vehicle. I placed Dwight under arrest for DUI / Alcohol by placing him in handcuffs, ensuring for proper fit, and double locking them.
I then verified Dwight’s age and immediately read him the Georgia Implied Consent Notice (Green Card) for Suspects 21 YOA or over. Dwight agreed to submit to the state administered chemical testing of his blood under implied consent.
Dwight was placed in the back seat of my patrol vehicle. I allowed Dwight to contact [REDACTED], which was his cousin, and she arrived and took the truck. I transported to the Carroll County Jail without incident or injury. While headed to the jail I asked dispatch to contact True Peaks blood draw and have them meet at the jail. Once Nurse [REDACTED] from True Peaks arrived, she was able to draw two vials of blood from Dwight’s right arm at 23:14 hours. Once the blood draw was completed Dwight was turned back over to jail staff. Nurse [REDACTED] sealed the blood kit and handed it to me. I logged the DOFS blood kit onto the log sheet and placed it in locker #3 and locked the door. I issued the following citations:

3)Stopping on the roadway 40-6-203
I placed all Court and Violations copies in the property in the patrol room.
