On 10/18/2025 at approximately 2050 hours, Sgt. Uglum notified me that he was out with a suspect vehicle from two hit and run accidents that occurred while I was at the jail. I told him that I would come interview the suspect once I left the jail.
Upon arriving at the suspect’s residence, [100 BLOCK] Greenfield Court, Carrollton, Ga 30117. I made contact with the driver, who was identified as Misty Dauphinee. Looking at Misty, she appeared heavily under the influence. She was stumbling around the garage and could barely stand. She had thick slurred speech and was belligerent. Sgt. Uglum introduced me as the traffic corporal and told her to speack with me.
As Misty spoke with me, she stated that she had driven her and her two children, 8 and 4 years of age, to Dairy Queen and back. She stated that when on the way back home she changed lanes and did not think that she hit a vehicle. Misty stated that she had a glass of wine at home for dinner before she went to Dairy Queen. I could see a stain around her lips that appeared to it could be from red wine. I also smelled the odor of an alcoholic beverage emitting from her breath as she spoke. Misty was also prescribed Xanax, but she stated that she had not taken any during the day.
I screened Misty for SFSTs. I performed Horizontal Gaze Nystagmus (HGN). During this test, I observed six out of six clues of impairment. Due to Misty’s impairment, she did not perform the Walk and Turn or One Leg Stand for her own safety to prevent falling.
Misty provided me with a breath sample, and the results read 0.190 g/BrAC and were positive for alcohol.
I advised Misty that she was under arrest for driving under the influence of alcohol. I read her the Georgia implied consent notice for suspects age 21 or over. She verbally stated yes to the request for a state-administered blood test. She was then transported to Carroll County Jail, where True Peaks drew her blood. The blood was later placed into evidence at the Carrollton Police Department. Misty was charged with the following:
OCGA 40-6-391A5 DUI- 0.08g or More
OCGA 40-6-391A1 DUI- Alcohol Less Safe
OCGA 40-6-391L Child Endangerment with DUI
COAG 40-6-270 Hit and Run
Misty had previous charges of DUI.
