On 6/11/2026 at approximately 2348 hours, I responded to 1124 North Park Street (Giovanni’s) in reference to a suspicious male. Dispatch advised a male was in the restaurant and seemed to be under the influence of alcohol or drugs. Dispatch advised that the male was refused service, walked outside to his car, and had his pants unzipped. Dispatch described the vehicle as a white SUV and stated that it was outside the restaurant, with the male in the driver’s seat.
Upon my arrival, I located a vehicle matching the description provided by dispatch, a 2022 white Nissan Rogue (GA:[REDACTED BY AGENCY]) parked outside the front door of Giovanni’s. I used my spotlight to illuminate the inside of the vehicle. I noticed a black male sitting in the driver’s seat with his head down. The male reacted to the light, raising his head. I approached the passenger side of the vehicle and began speaking to the driver, later identified as Tyrone Montgomery. I immediately saw a blue beer can in the passenger seat of the vehicle, which I recognized as a Bud Light. I could also smell the overwhelming odor of an alcoholic beverage and marijuana.
I noticed that Tyrone’s pants were unzipped, further matching the description given by dispatch. I could also see that Tyrone’s eyes were extremely bloodshot. I asked Tyrone for his license. Tyrone told me he did not want to give me his license and that he was trying to get food. I repeatedly explained to Tyrone that I needed his driver’s license and that I had received a call for service regarding him. Tyrone slurred his words heavily and seemed to be sluggish in his movements. Based on my observations, I suspected that Tyrone was under the influence of alcoholic beverages and/or drugs.
Tryone told me that he did not want to interact with me and indicated that he wanted to leave. I explained to Tyrone that he was being detained and that he was not free to leave. Tyrone argued with me, and based on his behavior, I feared he would drive away from the scene, posing a further hazard to other drivers on the roadway or to me. I requested additional officers to respond to the scene with lights and sirens. Multiple officers arrived on scene and blocked Tyrone’s vehicle from leaving.
With additional officers on scene, I walked to the driver’s side of the vehicle and asked Tryone again for his driver’s license. Tyrone began searching inside his wallet for his driver’s license. Tyrone pulled out several debit cards and other cards. I noticed that Tryone’s license was in the front of his wallet. I pointed this out to Tyrone and he finally located his license. Tyrone struggled to remove his license and was never able to hand it to me successfully. I asked Tyrone to exit the vehicle. Tyrone refused to exit. I gave Tyrone several opportunities to exit the vehicle. Tyrone stayed in his car, trying to put a card back into his wallet without success.
Tyrone eventually exited the vehicle, holding onto the side of the car to balance himself. I walked Tyrone to the rear of his vehicle and asked if he would consent to Standardized Field Sobriety Tests. Tyrone told me that he would not do SFSTs. I asked if Tyrone would submit to a portable breath test. Tyrone again refused. Based on Tyrone’s slurred speech, the strong odor of an alcoholic beverage on his breath, his sluggish movements, bloodshot eyes, and inability to divide his attention, I believed that Tyrone was driving under the influence of alcoholic beverages or drugs. Tyrone did admit to consuming one alcoholic beverage.
I placed Tyrone in double-locking handcuffs, both hands to the rear, and checked for proper fit. I instructed Tyrone to walk to my patrol vehicle. Tyrone was agitated and did not want to walk. I took Tyrone’s arm and walked him to my patrol vehicle. I searched Tyrone’s incident to arrest and located no items of interest. I then attempted to seat Tyrone in the rear of my patrol vehicle. Tyrone refused to sit in my patrol car. I explained to Tyrone that if he did not sit in the patrol vehicle, he would receive an additional charge for obstruction. I gave Tyrone numerous opportunities to take a seat, but he refused. I then pushed Tyrone into the seat, careful to make sure that he did not hit his head. Due to Tyrone repeatedly refusing to identify himself, step out of his vehicle, and enter my patrol vehicle, I charged him with obstruction.
After getting Tyrone in the rear of my patrol vehicle, I read him the Georgia Implied Consent Notice for Suspects Age 21 or Over. Tyrone spoke over me the entire time, and when asked if he would submit to a blood draw, he did not answer.
I searched Tryone’s vehicle incident to his arrest and located several open alcoholic beverages, including an open Bud Light beer and two Bacardi liquor bottles. I also located additional closed alcoholic beverages. Ofc. Darling located a clear plastic bag containing a green leafy substance in the rear of the vehicle. There was also an ingestion device with a burnt leafy substance, which smelled like marijuana, in the center console.
I spoke with the complainant, [WITNESS #1], inside Giovanni’s. [WITNESS #1], the on-duty manager, explained that Tyrone was inside the restaurant trying to place an order. [WITNESS #1] explained that Tyrone swayed heavily while inside the restaurant and was beliggerant. [WITNESS #1] believed that Tyrone was drunk based on his slurred speech, swaying, and his irate, loud, and disorderly behavior.
Larry Collins arrived to tow the vehicle. I secured Tyrone’s belongings in my patrol vehicle and placed the suspected marijuana in an evidence bag. I then transported Tyrone to the Carroll County Jail. I completed a DDS1205 form after Tyrone refused the blood draw. I then turned him over to the jail staff for booking.
I then dropped the suspected marijuana in evidence locker 021.
Tyrone was charged with the following:
- OCGA 40-6-391A4 DUI – Combo Alcohol and Drugs
- OCGA 16-13-2B Possession of Marijuana Less than an Ounce
- OCGA 40-6-253 Open Container (Driver Only)
- C66-7(A)(22) Obstruction
- C66-7(A)(21) Disorderly Conduct: Public Drunk
