On August 2nd at approximately 12:03 AM I was patrolling Bay Street at the intersection of E Lathrop. I observed a white SUV approaching me at a high rate of speed traveling west on Bay Street on the Viaduct. I activated my front antenna on my radar which displayed the vehicle traveling 60 miles per hour in a 40 mile per hour zone. As the vehicle closed the distance towards me, it activated it’s turn signal and changed into the left turn lane towards east Lathrop. I was able to identify the make and model of the vehicle as a White Chevy C15 SUV. I then activated my emergency equipment to conduct a traffic stop on the vehicle.
As I exited my and approached the driver side, I observed that there were four black males in the vehicle. As I began speaking with the driver, I was able to identify him by his Georgia Driver’s license as Mr. Jmaun Cutter. All four occupants in the vehicle were heavily intoxicated and I could smell a strong odor of Alcoholic beverage emitting directly from the vehicle. I asked Mr. Cutter where he was coming from, and he stated downtown. I then asked Mr. Cutter how much alcohol he had consumed tonight, and he stated, “one wine cooler at a cookout earlier today.” I observed that Mr. Cutter’s eyes were extremely bloodshot and watery. His speech was also slow and slurred as well.
I asked Mr. Cutter if it would be okay if I evaluated him to make sure he was safe to drive, and consent was given. As we talked towards the front of my vehicle I could smell a strong odor of alcoholic beverage emitting directly from Mr. Cutter’s person and breath. I also observed that his steps were slow and staggered. Before beginning Standardized Field Sobriety testing, I asked Mr. Cutter a series of questions. Mr. Cutter informed me of an injury that would prevent him from walking in a straight line or standing on one leg. I then began the Horizontal Gaze Nystagmus phase of SFST’s.
HGN: During this phase I observed 6 out of 6 clues. Mr. Cutter’s eyes did not pursue smoothly, distinct and sustained nystagmus at maximum deviation was observed in both eyes, and nystagmus onset prior to 45 degrees was observed in both eyes. Vertical nystagmus was also observed.
I then asked Mr. Cutter for a voluntary breath sample and after consent was given the results indicated positive for alcohol. Based on the clues I observed and the totality of the circumstances I then placed Mr. Cutter under arrest for driving under the influence of alcohol.
Furthermore, I read Mr. Cutter the Georgia Implied Consent notice for suspects ages 21 or over for the state administered chemical testing of his blood. Mr. Cutter refused consent and a refusal was documented.
Mr. Cutter’s Nephew arrived on scene, and after consenting to a breath sample, the results indicated negative for alcohol, and I then released the vehicle to him. Moreover, I then transported Mr. Cutter to the Chatham County Detention center for further booking and processing. All of Mr. Cutter’s paperwork, citations, 1205 form, and property were turned over to CCDC staff.
