On Wednesday, April 29th, at or around the time of 19:39 hours, I Deputy Reeves, was dispatched to the bridge on Highway 100, just south of Norton Road, for someone had called about smoke coming from underneath the bridge. Dispatch had notified me that fire was on scene. I was then notified by Cpl. Wilks that fire personnel [REDACTED], had relayed to him that there was a female subject there, later identified as Ame Rape, and that she smelled of the odor of alcohol, and was attempting to leave the scene.

Myself, and Cpl. Wilks then arrived on scene, and I began to speak with Ame. I more than 3 feet from Ame, and I could smell a heavy odor of an alcoholic beverage emitting from her breath. I then ask Ame how she got here, and she stated that she did drive her, her husband, and son to the bridge to do some fishing. I then asked Ame how much she had to drink, and she stated some. When I asked her how long it was since she had taken a drink she stated 3 PM this date, and time. I then asked Ame if she would be willing to perform field sobriety test for me which she said yes.

I then put Ame in position to check for HGN, and explained for her to keep her arms down by her side, and to keep her head straight, and still, and for her to follow the tip of my finger with her eyes, and her eyes only. I then made a pass to check for lack of smooth pursuit, and both of Ame’s eyes did not smoothly track my finger.

I then made a passes for maximum deviation, and each of Ame’s eyes jerked involuntarily. Ame had also showed signs of impairment in on-set prior to 45 degrees, as well as vertical Nystagmus. During the whole time I was administering HGN, Ame moved her head, when she was told to keep it still, and to follow with her eyes, and her eyes only.

I then put Ame in the starting position for the walk, and turn, where she then stepped out of the instructional phase, and made sure she was understood to remain there until I instructed her further. Ame then replied yes, and stepped out of the instructional phase. I then placed Ame back into the instructional phase, and made sure that she was clear to not move until being told to do so. I then began to demonstrate the first 9 steps up the line, when Ame once again stepped out of the instructional phase. I then finished conducting the demonstration of the steps, and began to explain the turn. Ame was told to keep her lead foot planted, and to take a series of small steps, and take 9 steps back down the line.

I then told Ame, to begin, which she had to put herself back into the starting position, which she did not fully commit to, it was as if she just started walking with her feet side by side, she then had to use her arms for balance, and stepped off the line 3 times. Ame then made an improper turn, by not keeping her lead foot planted, and turned the wrong way. Ame took 12 steps up the line, and 9 steps down. Ame’s balance was also poor during the walk, and turn throughout the duration of this test.

Due to Ame not listing to instruction, and her failing to keep her balance turning the walk, and turn, I then asked Ame if she would like to continue, and she stated that she would if I wanted her to. It was clear to me that Ame was not able to continue so I decided to stop field sobriety at this time. I then requested a PBT sample from Ame, which she agreed to. Ame then emitted a 0.10 on PBT.

I then placed Ame under arrest for driving under the influence of alcohol, and she was then read implied consent for her blood which she agreed to. Ame was then transported to station 12 for a blood draw, and then the jail, and there was no further incident.
