On July 6th, 2026, I, Deputy Dawson, was patrolling the area of Highway 114 when I noticed a white pickup truck with an off road light mounted and illuminated. I then turned around on the truck and activated my emergency lights to initiate a traffic stop. The driver turned onto Norton Road and stopped approximately 100 feet off the highway and almost into the ditch.
I approached the driver’s side of the vehicle and made contact with the driver, Mr. Benjamin Weeks. After I introduced myself and the reason for the stop as Mr. Weeks replied I smelled a strong odor of marijuana from coming from his breath and vehicle. I asked him for his license and he complied. I observed during this interaction that Mr. Weeks had watery eyes and a very slowed speech.
Before returning to my patrol unit I asked Mr. Weeks when the last time he smoked Marijuana was and he stated that he did not but his wife did. I then proceeded back to my vehicle and radioed for another unit to come to my location so I could perform a probable cause search of the vehicle.
While I waited for SO 15 Jerec Roberts to arrive I asked Mr. Weeks to step out of the vehicle so I could start my Field Sobriety tests. I ran the Horizontal Gaze Nystagmus and noticed a lack of smooth pursuit, and distinct and sustained Nystagmus at maximum deviation in both eyes. As I finished the first test Deputy Roberts arrived on scene and I let him finish giving the standard tests along with Modified Romberg and Lack of Convergence. During this I performed my probable cause search. During the search I found a THC Vape. The vape was collected and entered to be destroyed.
After my search I spoke with Deputy Roberts who advised that he had missed steps on the Walk and Turn. He also advised that the Modified Romberg time was one minute and twelve seconds estimated as thirty seconds. Deputy Roberts also advised me that Mr. Weeks had a lack of convergence. Both are signs of impairment and consistent with Marijuana.
I informed Mr. Weeks I was placing him under arrest for driving under the influence of Marijuana and he would receive a warning on the off road lighting equipment use. I then read Mr. Weeks the Implied Consent Notice age 21 or older and he refused the blood draw. I then transported Mr. Weeks to the jail without further incident.
