On 09/18/26, at 0032 hours, I Deputy Reeves was dispatched to the area of Silver Hill Rd, and Jenkins Gap Rd, for a vehicle possibly on fire. I then arrived on scene, and met with EMS personnel [REDACTED]. [REDACTED] informed me that there was no fire, but the items that I was observing was very off putting, and it was various medical supplies, and several blister packs of prescription narcotics.

I then approached the driver, Jason Powers. I then asked Jason what had happened, and he said that he was going to pick his wife up from Floyd County jail, when he noticed white smoke coming from his vents on his truck. While speaking with Jason I observed his appearance, and demeanor to be very polite, but sluggish, and relaxed. I had Jason wait by the ambulance, while fire conducted their investigation further.

While fire was finishing their investigation, I began to speak with Jason more, and collected his drivers license. I did smell what appeared to be a very faint odor of an alcoholic beverage coming off of Jason’s breath, so I asked Jason if he would be willing to perform some field sobriety test for me.

Jason then agreed, and I placed him in position for HGN. During HGN Jason could not track my finger smoothly, and he moved his head several times, after being reminded to keep his head still. Jason also swayed throughout the entire administration of HGN. Once put in position for the walk, and turn Jason then stepped out of the instructional phase, and tried to begin the test, without further instruction. I then placed Jason back in the starting position, and told him to remain in that position until being told to do so.

Once finished demonstrating the walk and turn, I told Jason that he could begin, and he stepped off line, used his arms for balance, made an improper turn, and took a total of 20 steps, instead of 18. During the One leg stand, Jason put his foot down multiple times throughout 10-20 second, and raised his arms.

During the finger to nose test, Jason had to be shown the test twice, and he again failed to listen to instructions. I told Jason when I give him the command of left, to bring his finger to his nose, and then bring it directly back down by his side. I then gave Jason the command, and he then left his finger to his nose for a span of thirty seconds.

While looking at Jason’s pupils, during HGN, I did observe Jason’s pupils to be very constricted, however his eyes did react very poorly to light, but during Lack of convergence his eyes did not converge, when I brought the stimulus in towards his nose, they stayed straight. This led me to believe that Jason was under the influence of a prescription narcotic, but in a poly drug mixture of possibly Gabapentin and Hydrocodone. There was a several containers, and blister packets recovered of the above narcotics found at the scene, however they did not have Jason’s name on them, one being his wife [REDACTED], and one a [REDACTED].

I then placed Jason under arrest for Driving under the influence of Drugs, and read him implied consent for persons of over the age of 21, which he consented to, as well as Miranda. Jason then stated later through interviews under miranda warning which he also accepted to answer without an attorney being present that the blister packs of Hydrocodone, and Gabapentin were a close long term friend of his, and that he was transporting his luggage for him in the rear of his truck.

I was able to make contact with his friend [REDACTED], at Redmond hospital, and [REDACTED] requested that his medication be took into safe keeping at the Sheriff’s office until he was able to come get it. Jason was then transported to Chattooga County Detention center and there was no further incident.
