On the date of 06/20/2026 at or around 02:22 hours, I, Deputy Reynolds was traveling South on Commerce Street near the intersection of Kelly street when I observed a vehicle that was also traveling south ahead of me fail to maintain its lane multiple times on the passenger side and nearly strike the curb.

I initiated a my emergency lights to conduct a traffic stop on the vehicle as I passed through the intersection. The vehicle slowed its speed and continued to fail to maintain its lane as we continued past the intersection of Commerce Street and Cleghorn Street. The vehicle continued South on Commerce Street eventually making a wide turn onto West First Avenue where it continued to drive slowly until it pulled into Willow Springs Park.

I exited my patrol vehicle and made contact with the driver Trey Moore and told him the reason for the stop was that he failed to maintain his lane and nearly hit the curd. Mr. Moore stated that he was aware and it was because he was digging into his McDonalds bag for food, It is noted that Mr. Moore did appear to have heavy eyes (Sleepy or exhausted look).

I ran Mr. Moore’s Drivers license through GCIC. I returned to the vehicle and asked Mr. Moore to step out of the vehicle. I explained to Mr. Moore that I had witnessed him pull out of the McDonalds and asked him where he was heading to. He stated he was headed home from Rome where his girlfriend was in the hospital. I asked for permission to search his vehicle to which he consented and explained that he had not traveled to McDonalds from the direction of Rome but that I had seen him traveling from Walker County on Highway 27 just North of Mountain View Road in Trion. Upon hearing this Mr. Moore seemed to become nervous and stated he must have gotten turned around on the back roads heading home from Rome.

While speaking with him while Deputy Wilson searched the vehicle I continued to see signs of possible impairment which were Mr. Moore was unsteady on his feet, swayed constantly, and continued to have heavy eyes. I asked Mr. Moore if he was on any medication and he stated no that he was just tired. I asked if I could run some field sobriety test to make sure he was ok to drive and he responded with “Sure I don’t drink”, I then turned off the front emergency lights on my vehicle and had him turn his back to the roadway.

The First Test that was conducted was Horizontal Gaze Nystagmus. While instructing Mr. Moore on how I wanted him to follow the tip of my pen with his eyes. Mr. Moore stated that he understood. During the medical clearance, I observed no resting Nystagmus, equal pupil size, equal tracking, heavy eyes, and that they also had no reaction to light and were slightly constricted.

During the testing, I did observe Mr. Moore have a lack of smooth pursuit in the left and right eye, onset of Nystagmus prior to 45 degrees in the left and right eye, and distinct and sustained Nystagmus at maximum deviation in the left and right eye. However, it is noted throughout the test that Mr. Moore would move his head to follow the stimulus on multiple occasions and had to be reminded to only follow with his eyes.

A total of 6 out of 6 validated clues for Horizontal Gaze Nystagmus were observed. Vertical Gaze Nystagmus was also conducted, and was observed. After concluding Horizontal Gaze Nystagmus I asked if he had any medical problems with his head, neck, or eyes due to the fact I was unsure if I had asked prior to starting the test. He stated “No”

The second test that was conducted was the Walk and Turn test. Prior to starting the instruction phase I did ask Mr. Moore if he had and medical problems with his back, legs, or feet and he stated “No”, I then repositioned Mr. Moore to a more level surface. I placed Mr. Moore in the starting position and told him to remain in that position until instructed otherwise and he gave verbal consent that he understood. Throughout the instructional phase he used his arms for balance and even almost fell over while trying to re-balance himself.

After all instructions were given Mr. Moore gave verbal consent the he understood all instructions. Mr. Moore attempted to complete the Walk and Turn 4 times before I stopped him due to safety concerns of him falling and hurting himself. However the validated clues I did observe were; unable to balance during the instructions, missed heel to toe, stepped off line, used his arms for balance, and stops while walking making 5 out 8 validated clues.

The third test that was conducted was the One Leg Stand, I positioned Mr. Moore with his feet together and arms down by his side and instructed him to hold that position until told to do otherwise and he stated that he understood the instructions, during the instructional phase Mr. Moore swayed and used his arms for balance.

Once he began Mr. Moore repeatedly placed his foot down and did not raise it as instructed after the third time Mr. Moore’s foot was on the ground I stopped the test. In total Mr. Moore could not hold his foot six inches off the ground more than approxamatley 3 seconds at a time before placing it back on the ground. A total of 3 of 4 validated clues had been observed.

I also conducted Lack of Convergeance and did observe that on both passes Mr. Moores eyes did not cross as the stimulus approached the bridge of his nose and when asked he did state that he did not believe they crossed.

I then conducted the Modified Romberg Test in which Mr. Moore did estimate the first passage of 30 seconds to be approximately 48 seconds and the second passage of 30 seconds to be approximately 43 seconds, during both attempts Mr. Moore was observed swaying continously.

The final test that was conducted was the finger to nose test in which Mr. Moore did only correctly perform once by following the instructions that he stated he understood. During the test he was observed bringing up his right hand and touching the tip of his nose, the other attempts Mr. Moore did miss the tip of his nose by touching the side of his nose.

Mr. Moore was placed under arrest for driving under the influence and was read his Miranda warning and did state that he was taking medication for a sleep aid and that he had took it 15 minutes prior to starting his drive to the hospital. I then advised Mr. Moore that even a prescribed medication could impair his ability to drive.

I then read him Georgia implied consent for suspects age 21 or older and he consented for a blood draw. I transported Mr. Moore to station 12 for the blood draw and then to the Chattooga County Jail without incident.
