Officer’s Narrative:

On the above date at 2058 hours I, Deputy Vincent, responded to a report of a hit and run in the area of Ridge Rd and Sixes Rd. While enroute I was informed that the victim had followed the suspect vehicle, a white Toyota Camry, down Bells Ferry Rd to North Victoria Rd and had gotten a license plate of [REDACTED] for the vehicle.

I met with the victim, [VICTIM #1], in the parking lot of McDonalds located at 3335 Sixes Rd. [VICTIM #1] told me that she was driving her White 2023 Toyota Camry (GA tag [REDACTED]) and she had just turned off of Sixes RD NB onto Ridge Rd WB just prior to the collision. [VICTIM #1] told me as she approached the private drive just past the McDonalds the suspect vehicle passed her using the right turn lane at a high rate of speed.

As the suspect vehicle came back into her lane the left rear side of the suspect vehicle struck the right front of [VICTIM #1]’s vehicle leaving very obvious damage to the bumper and quarter panel. [VICTIM #1] told me the driver of the suspect car then flipped her off and sped off making no attempt to stop. [VICTIM #1] then followed the suspect and initially called a friend before calling 911. [VICTIM #1] estimated the collision happened around 2048 hours.

[VICTIM #1] described the suspect vehicle as a white Toyota Camry with a bedazzled style rear license plate frame. [VICTIM #1] was not able to give a description of the driver. I conducted a GCIC query of the provided suspect vehicle tag, [REDACTED], and discovered it was registered to a White 2019 Toyota Camry to a [REDACTED] who lived at [400 BLOCK] Victoria Rd. I then conducted a Flock LPR search for this vehicle and confirmed that it was in the area as it passed multiple Flock Cameras along the same path descried by [VICTIM #1]. I then checked the CSO Fusus traffic camera at Ridge Rd and Sixes Rd and was able to view the video of the collision.

In the video I observed [VICTIM #1]’s vehicle turn onto Ridge Rd at a speed that appeared consistent with other traffic. Just behind [VICTIM #1] the suspect vehicle turned as well at a much higher rate of speed and quickly closes the gap with [VICTIM #1]’s vehicle. [VICTIM #1] then slows her vehicle near the driveway to McDonalds but does not come to a complete stop. The suspect vehicle appears to get very close to [VICTIM #1]’s vehicle then quickly changes lanes into the right turn lane for McDonalds without signaling and proceeds to pass [VICTIM #1]’s vehicle using the right turn lane before coming back into the straight lane in front of [VICTIM #1]’s vehicle without signaling and without the appropriate room causing an impact between the vehicles. The suspect vehicle is then seen quickly accelerating away from the crash scene with no obvious attempts to stop. The collision was determined to have occurred at 2049 hours.

After reviewing this information myself and Cpl. Nowiak responded out to the residence at [400 BLOCK] Victoria Rd at around 2200 hours. Upon arrival we made contact with Daisha Padgett in the driveway. As I spoke to Daisha she admitted to being the driver of the Camry and that she was involved in a collision. While speaking to Daisha I noticed the odor of an alcoholic beverage coming from her breath, Daisha stated that she had consumed the alcohol after she got back to the house and not before she left.

While interviewing Daisha she told me that she was on the way to the liquor store but had to turn around due to forgetting her wallet. Daisha explained that [VICTIM #1] was “riding her brakes” all the way down Ridge Rd and that [VICTIM #1] ‘brake checked’ her by the McDonalds and that after that she went around [VICTIM #1] using the turning lane for the McDonalds. Daisha believed that [VICTIM #1] accelerated while she was passing and that caused Daisha to strike [VICTIM #1]’s vehicle.

When I asked Daisha why she didn’t stop or call 911 Daisha replied that “they didn’t stop, I didn’t stop, they didn’t honk” or indicate that they were stopping so she continued. Daisha then claimed she pulled over at the next red light (later proved to be false) and that [VICTIM #1] had not followed her, I explained to Daisha that they indeed did follow her all the way to Ridge Rd which Daisha insisted was false since she didn’t follow her all the way to the house. Daisha also explained that she did now live at [400 BLOCK] Victoria Rd and had for about 6 months but she had not yet updated her license address.

Upon continuing the interview with Daisha I explained that she was under arrest for hit and run and instructed her to turn around, Daisha complied and I placed her into a pair of handcuffs behind her back which were checked for fit and double locked.

I then walked Daisha to the front of Cpl. Nowiak’s vehicle and began a search incident to arrest before Daisha requested a female deputy. I immediately stopped and requested a female via Cherokee 911 dispatch but both female deputies in Oak Grove were unavailable. I informed Daisha that there was not any available at the moment but that the search would be recorded and witnessed by Cpl. Nowiak, Daisha agreed and I performed a search incident to arrest with the back of my hand with nothing being located on her person. I then escorted Daisha to the backseat of my patrol vehicle where she was seat belted prior to transport.

I then spoke to the owner of the vehicle Daisha was driving, [REDACTED], who was not aware of the collision but stated she had given Daisha permission to use the vehicle. I provided [REDACTED] a case card and explained that a crash report would be completed.

Upon arrival at Cherokee ADC Daisha was released to the ADC deputies without incident. Daisha was issued citations for the following:

• Hit & Run
• Failure to Report Collision
• Improper Lane Change
• Overtaking on the Right
• Failure to Change License Address

The back seat of my patrol vehicle was searched for contraband before and after transport.

After going back in service and while preparing this incident report I pulled up Fusus video of Daisha as she drove from Sixes Rd at Vince Merolla Dr all the way back to the final available camera at Bells Ferry Rd and Ridge Rd. After reviewing the available video I observed that Daisha was operating the vehicle at a rate of speed that appeared much faster than the average speed of traffic on all available camera views. As she approached Bells Ferry Rd on Ridge Rd Daisha was also seen making another unsafe lane change and cutting off an unrelated white SUV as the SUV was approaching the red light at Bells Ferry Rd in this same video you can see [VICTIM #1] still following Daisha as they approach this intersection and continue south on Bells Ferry Rd.

Given all the observed driving infractions and the aggressive and unsafe nature of Daisha’s vehicle operation I determined that it was appropriate to add an additional charge of Aggressive Driving. I immediately contacted Cherokee ADC however I was informed that Daisha had already completed the bonding process and was walking out the door. Due to this a warrant for aggressive driving will be sought at a later date.

All Fusus video’s and Flock LPR hits have been uploaded to the Axon case folder. Crash report completed under this case number as well.
