On 12/8/2025 at 10:43 PM, I, D/S T. Scott responded to [1000 BLOCK] Poplar Rd in reference to a criminal trespass.

The caller, [WITNESS #1], stated that there was a man at their house and she did not know who it was. She said that he told her that he lived there and was laughing and walking around in circles. I arrived on scene and spoke to the man, who was later determined to be Shane Smith. He was unable to answer basic questions and had a strong odor of an alcohol beverage emitting from his breath. His speech was slurred and could not stand up straight without almost falling over. He could not answer where he was coming from and why he was at this property.

I was able to speak to his wife on the phone and she said that they live in Senoia and that he had been at Art and Jake’s eating dinner. She told me that the property where he drove to is where they get their dogs groomed and had no idea why he would be there.

I asked Mr. Smith if he would consent to field sobriety testing and he told me that he had not been driving. There was no one else in the car and the vehicle hit on Flock at the Poplar Rd/Exit 44 camera at 10:30 PM.

I observed that the vehicle had new front end damage on the front left bumper. The property owner, Ms. [WITNESS #1], saw that he had hit a tree next to the driveway as there were pieces of the truck next to the tree. There was no damage to the property and only minor damage to the truck.

At this point, I made my decision that Mr. Smith was impaired to the point where he could not safely operate a motor vehicle and that he was going to be arrested for Driving Under the Influence Alcohol.

Due to Mr. Smith being in physical control of a motor vehicle with the odor of an alcoholic beverage on his breath and his person, his bloodshot watery eyes, and from driving into a tree on a property that is not his, I determined that he was DUI-Alcohol.

At this time, I placed Mr. Smith under arrest and read him the GA Implied Consent to obtain his blood to which he agreed.

A vehicle search of the passenger compartment found nothing.

Mr. Smith was charged with:
DUI-Alcohol

Mr. Smith was transported to Newnan Piedmont for the blood draw and medical clearance and when the nurse started the blood draw he changed his mind and refused to have it drawn. Due to his level of intoxication the hospital was going to admit him for further testing and said it would take at least 6-8 more hours. At this point he was released from my custody on citations. A 1205 was filled out for the refusal.

The vehicle was towed by Platinum towing.
