On 04/24/2026 at approx. 1301 hours, I responded in emergency mode (lights and sirens) to 101 S Slappey Blvd (Checker’s) in reference to an unconscious individual inside of their vehicle.

Upon arrival, I made contact EMS (MED 2). EMS (MED 2) broke the driver side window of the white 2023 Ford Explorer displaying GA tag #[REDACTED], prior to police arrival. EMS (MED 2) was able to wake up the driver, Cedric Johnson. Johnson woke up in a confused state. I asked Johnson if he was diabetic or if he had any know medical problems. Johnson stated no. While Johnson was speaking, he was slurring his speech. I asked Johnson if he has taken anything that he was not supposed to. Johnson stated no. I asked Johnson if he has had anything to drink today. Johnson stated no.

Ptl. Bailey and Ptl. Battle arrived on scene. When Ptl. Bailey asked Johnson if he has had anything to drink today, Johnson stated that he had one beer. Johnson stated he didn’t know when he drink the one beer but that it was early this morning.

I made contact with the General manager [WITNESS #1] and the shift manager [WITNESS #2]. [WITNESS #1] stated [WITNESS #2] notified her that there was a vehicle sitting in the drive-thru and has been sitting there since she came into work. [WITNESS #1] stated [WITNESS #2] went outside to check on the individual (Johnson) and saw him asleep inside the vehicle with his foot on the break. [WITNESS #1] stated [WITNESS #2] asked her to come outside and help wake up Johnson. [WITNESS #1] stated she and [WITNESS #2] were banging on Johnson’s windows repeatedly and Johnson was not moving. [WITNESS #1] stated she then called 911.

[WITNESS #2] stated her shift started at 1200 hours. [WITNESS #2] stated that Johnson’s vehicle was already sitting in the drive-thru when she came into work. [WITNESS #2] stated after a while she realized the vehicle was still sitting in the drive-thru and it had almost already been an hour since she clocked into work. [WITNESS #2] stated she went outside and was banging on the window trying to wake up Johnson. [WITNESS #2] stated Johnson would not wake up so she went and told [WITNESS #1].

Johnson consented to perform a standardized field sobriety test (SFST). Ptl. Battle conducted the SFST. Johnson was read implied consent by Ptl. Battle. Johnson agreed to the state administered test of his breath.

Johnson was placed under arrest in handcuffs to the rear, double-locked. A search incident to arrest was conducted on Johnson for any weapons or contraband. There were negative results for any weapons or contraband. Johnson was placed in the backseat of patrol vehicle (23-140). I transported Johnson to the Dougherty County Jail. Upon arrival at the jail, I secured my duty weapon in the trunk of my patrol vehicle. Prior to leaving the jail, I conducted a search of the backseat of my patrol vehicle for any weapons or contraband. There were negative results any weapons or contraband. I secured my duty weapon back into my holster.

Deputy Officer Jonathan Pate at the Dougherty County Jail was the operator who administered the Intoxilyzer 9000 (Serial #90-001798). Johnson’s results showed 0.167 at approx. 1438 hours and 0.163 at approx. 1443 hours. These results will be logged into the Albany Police Department Evidence and Collections locker #02.

Johnson was given the following citations:

G0064630 – DUI – Alcohol Less Safe
D301023 – DUI – Per Se 0.08

A DDS 1250 was completed and Johnson’s license is attached to the form. A GCIC/NCIC check was conducted on Johnson, which came back negative for any wants/warrants.

This incident was cleared by arrest.
