I, Ptl Hatcher, made contact with Kenneth Payton via phone in reference to his wife having a friend over he did not like. I advised Kenneth that his wife could have over whoever she wanted and this was not a police issue. Later dispatch advised me that Kenneth had called Albany 911 multiple times cursing at the call taker.

I responded to Kenneth’s residence at [600 BLOCK] W Society Ave in reference to misuse of 911. On scene I made contact with Kenneth. I advised Kenneth that he could no longer call 911 if there was not emergency. I advised his if he did call again and it was not an emergency then he would go to jail. I advised him this was his only warning. Kenneth was also heavily intoxicated.

Several minutes later dispatch stated Kenneth had called back again for the same thing. I responded back to [600 BLOCK] W Society Ave and took Kenneth into custody. Kenneth was searched incident to arrest and placed into the rear of patrol car 18-176. Kenneth was transported to the Dougherty County Jail. At the Jail my duty weapon was secured in the vehicle. Kenneth was turned over to the jail intake officers. The rear seat of my patrol car was searched for contraband, none was found.

Kenneth was written a citation for unlawful use of 911 (G0047278).

I made contact with Dispatch and they were able to email a copy of the call logs. Kenneth called at 0022 hrs. this is when I made contact with him via phone and gave him a solution to his problem. Kenneth called again at 0105 hrs to report the same incident. Kenneth called back at 0133 hrs and I responded to his residence and advised him not to call 911 anymore for non-emergencies. At 0234 hrs Kenneth called back requesting PD for the same issue and was arrested for unlawful use of 911.

This case is cleared by arrest.
