On July 24th, 2022, at approximately 0011 hours, I was conducting a supervisor approved road check with Trooper Brown #860, two game wardens, and two Evans County Deputies at OLD GA HWY 250 and SR 129. A white Chevy Cruze with GA tag: [REDACTED] entered the road check.

I made contact with the driver, identified as Ethan Deloach and noticed that his eyes were bloodshot and watery. I immediately detected a strong odor of marijuana from the inside the vehicle. I also observed a child (12 years old) in the rear passenger seat with no seatbelt. I instructed Mr. Deloach to pull off to the side of the roadway and exit the vehicle. I asked Mr. Deloach to step in the front of my vehicle, while both Evans County deputies searched the vehicle. I asked Mr. Deloach if there was any marijuana inside the vehicle and he stated that there shouldn’t be.

I asked Mr. Deloach when he had last used marijuana and how much that he used. Mr. Deloach stated that he smoked 1 blunt “about 45 minutes to an hour ago”. I asked Mr. Deloach to pull down his eyelids and I observed reddening of conjunctiva. I asked Mr. Deloach to stick out his tongue and I observed raised taste buds on the back of his tongue. I asked Mr. Deloach if he would consent to Standardized Field Sobriety and Mr. Deloach verbally refused. I placed Mr. Deloach under arrest for Driving Under the Influence and read him the Georgia Implied Consent Notice for Suspects Under Age of 21. Mr. Deloach gave a verbal yes to a chemical blood test. I searched Mr. Deloach and placed him in the back seat of my patrol car.

Trooper Brown #860 waited with the vehicle and passengers and released the vehicle to Mr. Deloach’s father. I returned to my patrol vehicle and noticed a strong odor of marijuana and asked Mr. Deloach if he had any marijuana on his person. Mr. Deloach hesitated to answer, and I instructed him to step out of the vehicle. Mr. Deloach stated that he needed the handcuffs off to reach where the contraband was on his person. Mr. Deloach reached inside of his pants, near his crotch region and pulled out a clear plastic bag containing multiple buds of a green leafy substance. I secured the evidence in my vehicle.

I transported Mr. Deloach to the Evans County Sheriff’s Office and his blood was drawn from his left arm at 0110 hours, by AEMT [REDACTED]. I secured the labeled blood tubes in the GBI blood test kit. The contraband found on Mr. Deloach was submitted for testing at the GBI crime lab. I released custody of Mr. Deloach to Deputy Mark Gatto without further incident.
