On Tuesday July 07, 2026 at approximately 2218 hours, I was traveling northbound in the right lane on N Glynn St just north of its intersection with E Lanier Ave when I observed the vehicle (2021 Jeep Grand Cherokee black in color GA tag: [REDACTED]) merge slightly to the left and drive over the center line with its driver side tires.

The vehicle then merged back onto the right lane. I the made a GCIC inquiry on the tag and learned that the vehicle had an expired registration with expiration date of 07/03/2026. I continued behind the vehicle and activated my emergency equipment to initiate a traffic stop. The vehicle came to a complete stop in the parking lot of the BP (450 N Glynn st).

I approached the vehicle on the passenger side, identified myself and advised the driver (Ashley Bynoe) the reason for the stop. Bynoe stated that her birthday was three days prior and she forgets every year. While speaking with Bynoe, I could smell a strong odor of alcoholic beverage emitting from inside the vehicle. I could also observe her eyes to be watery and bloodshot.

She provided me with her drivers license. I asked her if she had proof of insurance to which she stated she had it on her phone. I then went around the vehicle to the driver side. While waiting for her to find her insurance information, I could also smell the odor of alcoholic beverage emitting from the vehicle. One drink at her grandmother’s approximately two hours prior.

I asked her to exit her vehicle. I explained my concern for her safety while driving, and she consented to participate in field sobriety evaluations.

I asked Bynoe if she had any medical issues that would keep her from performing field sobriety evaluations to which she stated no.

Bynoe then asked what would happen if she would refuse to do fields to which I explained to her that I would continue my investigation from there and I was just doing field sobriety tests to make sure that she was safe to drive home. She asked again what would happen if she refuses and stated that she just needed to know the full thing before she agreed.

I explained to her that I could smell the odor of alcoholic beverage, she had stated she had something to drink and her speech was slurred. She asked multiple more times what declining would mean to which I explained to her again that I would just continue with my own investigation and related paperwork to include a warning for the expired registration. She then stated that she wanted to proceed with the tests.

I then administered field sobriety tests.

HGN – 6/6 clues
[BYNOE]’s eyes were checked and her eyes tracked equally and pupils were of equal size.

The test revealed:

• A lack of smooth pursuit in both eyes.
• A distinct and sustained Nystagmus at maximum Deviation.
• An onset of Nystagmus prior to 45 degrees.

Walk and Turn – 2/8 clues

Instructional Phase:

• Broke instructional position.

Walking phase:

• Broke heel to toe.

One Leg Stand – 0/4 clues

I then asked Bynoe to provide a breath sample in the PBT. When she saw the PBT in my hand, she stated that “now we’re cooking with grease”. She stated that she did not know what that was, what she was doing and what the consequences were of doing it. She also stated she needed to know if she had the right to deny it. I explained to her that it just shows of there is presence of alcohol in her breath. She then asked what would happen next. I explained again that it just tells me if there is a presence of alcohol in her breath.

She continued to ask “then what?” and wanted to make an informed decision. I continued to explain to her that she could decline and she continued to say that she did not have enough information to make a decision. I explained to her what it did. She continued to say that she did not believe she had enough information. Due to explaining multiple times what the PBT entailed and Bynoe not understanding, I took her lack of response as a refusal.

Due to Bynoe’s physical manifestations, performance on her field sobriety evaluations and a strong odor of alcoholic beverage emitting from her breath, I placed Bynoe under arrest for DUI. Bynoe was placed in handcuffs, checked for fit and double-locked to the rear. [BYNOE] was read Georgia Implied Consent Notice for People over the age of 21 for breath to which she responded “No”. I then re-read Implied Consent Notice for blood to which she also stated “No”. Bynoe was searched for weapons and contraband and was placed in the rear seat of my patrol vehicle. She was secured with a seatbelt.

A vehicle search was conducted and no open containers were located.

Bynoe was transported to the Fayette County jail where she was released to jail staff on a citation for DUI. Her license was surrendered and returned to the state per DDS-1205. While signing the 1205 form, Bynoe stated that I had not advise her about the notice of suspension and that her license would be suspended for one year. I told her that the Georgia Implied Consent Notice for People over the age of 21 that I read to her had that information. She then signed the copy.

Before leaving the jail, Bynoe stated that for her birthday a few days ago, she had received a bottle of alcohol that had been opened in her vehicle so the odor of alcohol was from that. I stated to her that I smelled the odor of alcoholic beverage emitting from inside the vehicle while she was in it. Once she exited the vehicle, the odor came from her, and when I searched the car, there was no odor of alcoholic beverage. The rear seat of my patrol vehicle was searched before and after Bynoe was placed in it.
