Cherokee County – A homeless man was charged with rape and sodomy after attacking a Snapchat acquaintance during a house party. The victim was house-sitting in the apartment where the rape occurred.
Joshua Dean Cowart, who was living in his car in a parking lot, was arrested on August 15 and booked into the Cherokee County Adult Detention Center. He is charged with ‘Rape,’ ‘Aggravated Assault- Strangulation,’ and two counts of ‘Aggravated Sodomy.’
On August 5, Cowart was invited to a house party hosted by the victim. He is accused of attacking her in the bedroom of the apartment at approximately 3 AM.
The victim told her mother about the attack the following day and was taken to the hospital for a sexual assault examination. Police were notified and a report was made. When discussing the incident with investigators, the victim advised that she did not know Cowart’s full name or his contact information. The victim also advised that the sheets and other evidence was still in the apartment.
On August 15, an investigator with the Cherokee Sheriff’s Office contacted another deputy and notified him that Cowart agreed to an interview and needed transportation to the Sheriff’s office. The deputy located Cowart and drove him to meet the investigator.
After this meeting, the investigator provided the deputy with arrest warrants, and Cowart was placed under arrest and taken to the adult detention center.
Attorney Archie Speights was appointed, on August 19, by the Superior Court of Cherokee County to represent Cowart. Speights filed a Motion for Bond, which will be considered on September 26.

[NARRATIVE #1 on July 06, 2022]
On Wednesday, 07/06/22, I met was dispatched to a Rape that occurred at the Quincy Apartments. The victim, [REDACTED BY AGENCY], was currently at Kennestone Hospital.
[REDACTED BY AGENCY] said she was house sitting an apartment at the Quincy’s on 07/04/22. She did not have the apartment or building information available at this time. With the homeowner’s permission she invited people to the apartment for a party. One of these individuals was a male named Joshua, who [REDACTED BY AGENCY] knows from Snapchat. [REDACTED BY AGENCY] does not know Joshua’s full name, nor contact information.
At approximately 03:00 on 07/05/22 [REDACTED BY AGENCY] said Joshua sexually assaulted her in the bedroom of the apartment. [REDACTED BY AGENCY] said the homeowner of the apartment has not returned to the apartment nor have the sheets been changed since the incident. She was transported to the hospital by her mother. I contacted Investigator Garland and provided him the information for the case for immediate follow-up.

[NARRATIVE #2 on August 15, 2022]
I received a phone call from Investigator Whitfield regarding a suspect she needed to interview. Investigator Whitfield stated the suspect, Mr. Joshua Cowart was homeless and living in his vehicle in the parking lot of an apartment complex inside Cobb county. Investigator Whitfield stated she had spoken to Joshua and he had agreed to an interview, but was unable to drive his vehicle to her office. Therefore, I was asked to make contact with Mr. Cowart and give him a ride to her office.
I arrived at the apartment complex and located Mr. Cowart’s vehicle. He was not in it, or around it, so I called Investigator Whitfield to let her know. She, in turn called Mr. Cowart who stated he had walked away from his vehicle, and would come back there shortly. I waited a few minutes and Mr. Cowart arrived. I told him who I was, and asked him if he wished to secure his vehicle before we left. Mr. Cowart stated he did not wish to lock his car. I patted Mr. Cowart down for weapons, and sat him in the rear seat of my patrol vehicle.
I then transported him to the South Annex of the Sheriff’s Office. There we met with Investigator Whitfield. She escorted Mr. Cowart to an interview room, and I waited out in an office area. After several minutes, Investigator Whitfield emerged and stated Mr. Cowart was ready to be transported to the ADC. She stated she had warrants for his arrest, and handed me copies. The warrants she handed me were for Rape, Aggravated Assault (Strangulation), and two counts of Aggravated Sodomy (Anal & Oral).
I asked Mr. Cowart to stand up and turn around. I told him he was under arrest. I placed handcuffs on his wrists. I double-locked them, and checked them for fit and security. I then collected Mr. Cowart’s property and escorted him out to my vehicle. I secured him in the rear seat. I then transported Mr. Cowart to the Cherokee County Adult Detention Center without further incident. Upon arrival at the ADC, I filled out the necessary paperwork and booking information, and then relinquished custody of Mr. Cowart to the intake deputies. I turned over Mr. Cowart’s property to the jail staff, along with the copies of his warrants. I then returned to service.
