On Sunday August 23, 2026 at approximately 12:22am I, PFC Z Colvin, observed a gray Toyota Tacoma bearing Alabama registration [REDACTED] make a left hand turn from Reservoir St onto Turner Mccall Blvd. There is a no left hand turn sign at that intersection. Then after making the left hand turn, the vehicle turned into the right lane and briefly crossed over the white line on the right hand side. I then initiated a traffic stop as the vehicle pulled into the parking lot of the Days Inn located at 840 Turner Mccall Blvd.
I then made contact with the driver who was identified as Armando Paramo. I told him why I stopped him and he did not realize he could not make a left hand turn there. He thought it was okay because there were no cars coming and it was not dangerous. While speaking with him I detected the odor of an alcoholic beverage on his breath and I had him step out of his vehicle. I asked how much he had to drink and he told me a couple beers. He then specified 2 or 3 beers.
I asked if he thought he should be driving and he stated he should not be, but he was only going a short distance. I asked if he would take a field breath test and he told me he would not because he had more than 2 beers. He did say he would do field sobriety testing.
The first test I had him do was the horizontal gaze nystagmus test. I observed the following 6 clues on the test:
Lack of smooth pursuit in both eyes
Distinct and sustained nystagmus at maximum deviation in both eyes
Onset of nystagmus prior to 45 degrees in both eyes
I did not observed vertical nystagmus. I did observe his eyes to be bloodshot and watery.
The next test I had him do was the walk and turn. He started the test too soon.
The final test he did was the one leg stand. He used him arms for balance, swayed, and put his foot down.
I then determined he was DUI. I told him he was under arrest for DUI and placed him in handcuffs. He was searched and placed in the back seat of my patrol car. I read him Georgia Implied Consent for suspects age 21 and older. He refused to take the stated breath test. I then re-read Georgia Implied Consent and this time asked for a blood test. He would not answer. I told him that not answering would be considered a refusal. He still did not answer and I logged it as a refusal at that time.
The vehicle was left in the parking lot of the Days Inn.
I then transported Mr Paramo to the Floyd County Jail where he was booked in on citations for DUI and making an improper left hand turn. I also filled out an ALS form which will be sent to the DDS with his driver’s license.
