[NARRATIVE #1 on May 09, 2026]

On Saturday May 9, 2026 at approximately 13:56 hrs while I was on duty, dressed in full uniform, and driving a city of Rome marked police vehicle I responded to 1201 Turner McCall Blvd in reference to two subjects on the lot on a physical altercation. Rome/Floyd E-911 dispatcher advised that a black male and a white male were the two parties involved, and prior to my arrival I was advised that the black male left the scene headed down Turner McCall Blvd toward Riverbend Dr.

When I arrived on the scene I made contact with witness: [WITNESS #1] and she pointed at a male the subject identified as Benjamin Robinson who was now sitting in front of the CVS stores entrance. [WITNESS #1] stated that when she pulled up on the lot she observed a black male standing over Robinson while Robinson was down on the ground. She stated that the black male then left the area.

I then approached Robinson to see what happened and I observed that his face was bloody and his top lip was split and bleeding. I asked Robinson if he knew the subject that he was involved in the altercation with and he stated “No I didn’t know that n*gger” Robinson then attempted to spit in my direction several times before stating ” f*ck Rome” and then he threw what was left of a cigarette at me and stood up in a aggressive manner coming toward me and said “f*ck you n*gger” Robinson again attempted to spit at me I grabbed his face and turned it away from me and took him down to the ground.

While on the ground I gained control of one arm and placed a handcuff on it. [REDACTED] arrived and assisted getting Robinson to turn over while I gained control of the other hand to complete the handcuffing. While Robinson was on the ground he again stated “f*ck you n*ggers” and once he seen [REDACTED] he stated “f*ck you crackers”.

Robinson was assisted off the ground by myself and [REDACTED] and while we escorted him toward my patrol vehicle he attempted to head butt both myself and [REDACTED]. Officer Chaves arrived on the scene and while Robinson was being escorted he was able to kick and strike Officer Chaves in her leg.

Robinson was placed in the back of my patrol vehicle and we were waiting on Floyd Emergency Services to arrived to check on Robinson. Sgt Rast sat in my patrol vehicle drivers seat to assess the injuries that Robinson had sustained in the previous altercation. Robinson still acting reckless spit through the open part of the partition, getting blood in Sgt Rast mouth and on his face.

Robinson was transported to Atrium Health (Floyd Medical Center) where he was treated and released and transported to the Floyd County Jail where he was booked for

1)Reckless conduct
2)obstruction of officers (3x)
3)simple assault criminal attempt
4) disorderly conduct

Contact was made with [VICTIM #1] who was the other subject involved in the altercation with Robinson. [VICTIM #1] advised that he was stopped in traffic when Robinson approached the vehicle and through a open window pointed his finger in [VICTIM #1] face making contact with [VICTIM #1] and asked him if he wanted to fight. [VICTIM #1] stated that the two did engage in a physical altercation.

[NARRATIVE #2 on May 09, 2026]

On Saturday 5/9/2026 I, Ofc Chaves was dispatched to CVS on Turner Mccall Blvd in reference to a fight. While en route to CVS dispatch advised the other party involved left in a silver Hyundai vehicle and was going toward Chillis restaurant. I was on E 2nd Ave near Riverbend Dr and advised dispatch I would be on Riverbend attempting to locate the vehicle. Dispatch advised the other individual that was involved was requesting EMS.

PFC Drew was on scene and advised he was in a fight with the subject later identified as Benjamin Robinson at CVS. I then activated my lights and siren and arrived to CVS. Upon my arrival Mr. Robinson was already in handcuffs and when I walked toward PFC Drew and Mr. Robinson, Mr. Robison yelled “f*ck you stupid cracker” and intentionally spit toward my direction while intentionally kicking my right leg. While escorting Mr. Robinson to PFC Drews’ patrol vehicle Mr. Robinson also kicked my patrol vehicle while trying to flail his head backwards to head bump PFC Drew.

I then spoke to a witness: [WITNESS #1], who stated she observed the white male on the ground and a black male standing over and saw they were fist fighting as well. The witness stated the other subject then got into his vehicle and left.

Mr. Robinson was transported to Atrium Floyd for medical treatment for his lip from his physical altercation prior to our arrival. Mr. Robinson at first stated he did not know what happened multiple times then told a nurse that someone was calling his name and talking about military things to him which caused him to yell at someone in a vehicle and then a fight broke loose.

After medical treatment was received Mr. Robinson was transported to Floyd County Jail by PFC Drew. SEE PRIMARY FOR FURTHER.

[NARRATIVE #3 on May 09, 2026]

On May 9th, 2026 at approximately 1420hrs, I responded to assist PFC Drew at 1201 Turner Mccall Blvd. PFC Drew advised over the radio that he had been involved in a fight with a subject and, as the on-duty supervisor, I responded to hear PFC Drew’s statement of the incident and to inspect both the Officer and the suspect for any injuries.

Once I arrived, I spoke to PFC Drew and he stated that when he arrived to the call, he approached the suspect, identified as Benjamin Robinson, who had been involved in a physical fight and had a busted lip. Robinson began shouting racial slurs and profanities at PFC Drew while also spitting blood and saliva in his general direction. Robinson then got up from his seated position and lunged at PFC Drew, causing Drew to react by pushing Robinson backwards to the ground. PFC Drew, with the assistance of civilian [REDACTED], was able to restrain Robinson with handcuffs and escort him to the patrol car.

PFC Drew had a small scrape on his left elbow and no other injuries.

Knowing that Mr. Robinson had spit at PFC Drew, when I went to inspect his injuries I opened the window of the driver side rear of PFC Drew’s car so I was on the opposite side of where Mr. Robinson was seated. I asked him to turn toward me so I could see his face and Mr. Robinson made no attempt to turn his head. At this point, I decided the only way to safely see Mr. Robinson’s face was to sit in the front seat and look through the clear glass prisoner partition.

As I was inspecting his face, Mr. Robinson spit blood and saliva through the port hole in the partition, striking me in the face and mouth, right arm and on my vest. I immediately exited the car and advised dispatch that I needed EMS so I could get cleaned up. PFC Roden assisted me with locating and wiping off most of the blood that was on me. Once EMS arrived, we used disinfectant wipes to clean the affected areas. While disinfecting my equipment, I also observed blood on my sunglasses, which I was wearing over my eyes while inspecting Mr. Robinson’s injuries.

I then drove to Atrium Health Floyd Hospital to check myself in to have blood drawn for testing. A search warrant was typed and executed for Mr. Robinson’s blood to test for any communicable diseases. At the time of this report, I have received verbal confirmation from my treating physician that there was no evidence of communicable diseases in mine or Mr. Robinson’s blood but I have not received documentation.
