[NARRATIVE #1 on March 22, 2025]

On March 22, 2025 at approximately 1:03am. A call came out that someone in the area of Woodberry Dr had been shot. At the time of the call dispatch could not give a better location. I advised that I would be en route to assist with this call along with other officers. Prior to our arrival dispatch was able to get an address of [40 BLOCK] Woodberry Dr Apt. [REDACTED]. Pfc. George and Pfc. Bodenheimer arrived on scene a few minutes before I arrived.

Once on scene, Pfc. Bodenheimer had one subject detained in the back of his vehicle. Pfc. Bodenheimer requested that I stay with the detained subject, who was identified as Victory Anthony Outley. While speaking with Victory he advised that his handcuffs were too tight. At this time Pfc. Bodenheimer and myself took him out of the back of the patrol car and placed a larger pair of handcuffs on him. He requested to stand outside of the vehicle due to him only being detained at this time.

While at the front of the patrol car Victory began to tell me what had occurred leading up to the incident. Prior to allowing Victory to tell me the story I read him his Miranda Rights. After reading Victory his rights he began to explain what happened.

Victory advised that his daughter Nyrayah Davis had called him from the Woodberry Dr address asking him to come pick her up. He advised that Nyrayah was visiting with Cedric Nicholson, and his girlfriend [VICTIM #1]. Victory advised that Cedric became jealous of Nyrayah and [VICTIM #1] because Nyrayah was rubbing [VICTIM #1]’s back. At this point a verbal altercation occurred between the three and this is when Nyrayah asked him to come get her.

Victory advised that when he got to the residence he was calm and friendly with Cedric however, Cedric did not reciprocate these actions. Victory advised that Cedric became irate and pulled a gun out from underneath the couch and pointed it in his direction. Victory advised at this point he was in fear for his life and began to fight with Cedric over control of the gun. Victory advised that during the tussle the firearm was discharged, and Cedric attempted to aim it in his direction again. Victory advised that they continued to fight over the gun. Victory advised that he gained control of the gun by biting Cedric’s ear.

Victory advised that once he gained control of the gun he took the gun to his car to prevent Cedric from getting the gun, and waited for law enforcement to arrive.

When the firearm was discharged, [VICTIM #1] was struck in the hand. EMS transported her to the hospital for treatment. Both Victory and Cedric were detained for further investigation. While waiting for Investor Roubieu, Victory continued to talk to me about the incident. He advised me that he and Cedric had been friends for approximately six years prior to this incident. He advised that Cedric thinks he can’t be touched because he sells drugs from his house and has developed some sort of superiority complex. Victory advised me that there was some type of gray container inside of the living room that contained the drugs that Cedric had been selling. I advised Sgt. Holbrook, Inv. Roubieu, and other officers on scene of this information. A short while later a gray container was located inside of the house with drugs and items used to traffic drugs as well in the area that Victory had described.

I also discovered later that there were two children present inside of the home during the incident as well. As I stayed with Victory there were other officers on scene that spoke with Cedric and [VICTIM #1]. I didn’t speak much with Nyrayah in regard to the incident due to her and Victory being in such close proximity to one another. However, what she did tell me aligned closely with what Victory had told me.

Nyrayah had also been drinking while at this address. Nyrayah was charged for underage consumption due to her not yet reaching the age of 21 years old. Victory and Cedric were arrested on charges to be determined by Inv. Roubieu.

[NARRATIVE #2 on March 22, 2025]

On the date and time listed above I, OFC. J. BODENHEIMER, was dispatched to [40 BLOCK] Woodberry Dr. Apt. [REDACTED] in reference to a gun shot wound. Prior to arrival dispatch advised that one female had been shot but was not sure who had shot her. When I arrived on scene I noticed there was a black male getting out of a white car in front of the residence. The male immediately put his hands up in the air. I placed the male in handcuffs and advised him that he was being detained for right now. As I was putting him in the back of my Patrol Car the male stated that the gun was in the driver seat of his car.

I went to the vehicle and retrieved the gun from the vehicle while wearing gloves. I took the magazine out of the gun and went to clear the chamber but it was already cleared. I then placed the gun in a plastic bag and placed it inside my Patrol Vehicle. I then went inside the residence to help render aide to the gun shot victim but by this time PFC. GEORGE and PFC. FORRISTER were already inside helping the victim. I then went back outside to my Patrol Car to standby with the male that I had detained.

PFC. DUTTON had arrived on scene and the male inside my Patrol Car was asking to get out to stand up and also stated that the handcuffs were very tight. Myself and PFC. DUTTON then took my handcuffs off of the male and placed him in PFC. DUTTON’s handcuffs since her had larger handcuffs. The handcuffs were then checked for fit and double locked. The male was identified as VICTORY OUTLEY. I waited for INV. ROUBIEU to arrive on scene since he was called out. INV. ROUBIEU arrived on scene and conducted his investigation. Based on INV. ROUBIEU investigation VICTORY was placed under arrest and placed in the back of my Patrol Car. VICTORY was transported to Floyd County Jail where he was medically cleared and taken into custody by jail staff.

[NARRATIVE #3 on March 22, 2025]

On the above date and time I, PFC Vasser responded to a advisory by E-911 Dispatch. Dispatch advised that someone had been shot at [1300 BLOCK] Dean Ave, but later advised that a lady had been shot in the hand at [40 BLOCK] Woodberry Drive APT [REDACTED]. I activated my emergency lights and audible siren and proceeded to the residence. While running emergency on SR 27S approaching the exit to SR 101 I hit a bump in the road that caused my Public Announcement hand microphone to activate that cause my siren to cut off so I pulled over and corrected the issue, and I continued to run emergency to the residence.

Upon arrival I met a neighbor that was running toward the residence so I stopped him and asked what he had saw. He advised that he didn’t see anything he had just received a call from his friend to come over. I advised the neighbor to not come into the area due to it being a active crime scene, and then I proceeded to the residence to ensure no one needed assistance. I entered the residence where OFC Bodenheimer and PFC George was. I then ended up staying inside the residence with Cedric Dwinell Nicholson (Offender, Victim, Arrestee) who is the husband of the gunshot victim. Cedric advised that he had just got home from the hospital from getting his throat checked out. He stated that when he came inside he noticed his son was still up so he told his wife to go lay him down, and a female friend went back with his wife and child, and was rubbing on his wife.

He advised that he told her she needed to get out of there, and she began going off on him. She then called her mother and father, and the father, Victory Anthony Outley (Offender, Arrestee) came to the house. He advised that Victory came into the residence and began walking up to him, and due to a past incident of Victory jumping on him he told him to not walk up on him. Cedric then stated that Victory punched him and they fell into the couch. Cedric advised that he grabbed the gun from under the couch cushion because he was going to protect himself and his family, and then they both started wrestling over the gun. Cedric then stated that they both then went from the couch to the floor between the living room and the kitchen, and he was faced down being hit by Victory before he had heard the gun go off. He advised that he thought his son was shot until he heard his wife scream that she was hit.

Cedric advised that he had cameras so i asked if he could pull them up for me. Cedric stated that he didn’t have a camera in the living room, but there was one outside facing the front door so he pulled that one up for me to see. I observed video of outside the residence and audio from inside the residence. I could heard what sounded like a female arguing with someone, and a white car driving toward the residence at a high rate of speed before stopping directly in front of the driveway. I observed a black male (identified as Victory) walk to the front door and knock before a female is heard saying come in. Cedric advised that the female who said come in was Victory’s daughter, and that neither him or his wife gave permission for Victory to enter the residence. Once Victory entered the residence I could hear a male begin yelling along with a female yelling until I hear several start yelling, and I hear a female yelling “Papi stop” several times.

Cedric advised that the female that was screaming papi stop was Victory’s daughter. He stated that at that time is when Victory began hitting him. I could hear a lot of screaming, but I couldn’t make out what all was being said or who was saying what. I then heard a gunshot and seen Cedric’s wife come running out the door screaming “someone call 911” several times before going back inside the residence. I could hear more screaming from several individuals before observing Cedric’s wife going outside once more. It appeared that she ran to the end of the driveway and then back to the front door. The entire time she was gone outside I could still hear a female inside the residence screaming “Papi Stop”.

Cedric’s wife came back to the front door and said “yall shot me” and Victory came outside with the pistol in his left hand, and Cedric’s wife began running away from him saying “no, get away” and “get away from me”. Victory then turned around with the pistol still in his hands and entered the residence again and is heard saying “he shot you”, and then “I don’t give a fu*k I’ll do it again”. After he entered the residence I began hearing screaming, and I heard the female inside start screaming “Papi Stop” again before Cedric’s wife entered the residence once again saying “no”.

Once Cedric’s wife entered the residence again I began hearing a female screaming “Papi we got to go home”, “Papi please”, and “stop”. Victory, his daughter, and Cedric’s wife was then seen exiting the residence with Victory’s daughter pushing on Victory’s back which appeared to be her trying to get him to go to his vehicle. I then see Cedric poke his head outside the front door, and then come running outside asking for help to cut the water off due to the bullet hitting a pipe under the kitchen sink. Victory is heard saying that he wasn’t going to help him do anything, and began approaching Cedric so Cedric ran back inside the house. I reviewed the camera footage several times by myself and with Sgt Holbrook. Sgt Holbrook asked Cedric if he was a convicted felony, and Cedric advised that he was so he was detained and placed in handcuffs.

Cedric was advised that since he is a convicted felon he is not allow to be in a residence that allows him to have access to firearms, and that if a firearm is in the residence it needs to be locked up to where he can’t get to it. Cedric stated that he was unaware that he couldn’t be around firearms, and he thought he just couldn’t own one. Sgt Holbrook asked Cedric several time if he had grabbed the gun first due to being scared, and Cedric stated that he didn’t grab the gun Victory did. After Cedric was told that if it was found out later that he did grab the gun first it would appear bad on him because he lied he advised that he did grab the gun but it was not loaded. He stated the Victory chamber a round into the pistol before firing it, and that Victory pointed it at him twice.

Once INV Roubieu arrived he began speaking with Cedric about the incident after he was read his Miranda Rights. Cedric was advised that Victory stated that he had a lot of marijuana inside the residence and that the odor of marijuana was present. Cedric was made aware that a search warrant could be obtained to find any marijuana inside the residence, but Cedric advised that he didn’t have a lot of marijuana inside and gave us permission to look inside his box beside the couch to get what marijuana he had. A scale, bags, a bag of smoked marijuana joints, and erectile dysfuntion pills were found inside the box.

Cedric advised that the bag of smoked joints were being saved for his daughter in Atlanta to smoke. [VICTIM #1] had been at the residence and had taken Victory’s daughter home due to how she was acting outside. Once INV Roubieu decided that he was going to take charges on Cedric we waited for [VICTIM #1] to return to the residence to watch over his son and daughter that had been asleep in the bedroom I walked Cedric out to my vehicle, conducted a search incident to arrest, and transported him to the Floyd County Jail to be booked.

[NARRATIVE #4 on March 22, 2025]

On 3-22-2025 at approximately 0003 hrs I responded with other officers to the incident location in reference to one or two people possibly being shot. Upon arrival one individual was in custody and speaking with Ofc Dutton who was reading him miranda warnings. He stated he had came to the residence due to his daughter calling him and advising there was an issue at the home with Cedric being rude. He said he came over and went inside and sat down and talked to Cedric. At some point the conversation got heated and Cedric pulled out a gun and pointed it at him. He said they struggled over the gun and went to the ground. The gun went off and shot the victim through the hand. There was only one victim shot.

When I went inside Ofc Vasser was with Cedric inside the home. Cedric advised that Victory Outley came to the residence and came inside being very aggressive toward him. He stated as the discussion got heated, Victory was aware of the hidden gun in the couch and grabbed it pointing it at him and making threats. He said the struggle led them to the ground and the gun went off shooting the victim through the hand. He did have video surveillance which recorded the audio of the incident and the outside of the residence. It did appear that Victory did come in the residence and shortly afterwards became very loud and argumentative for quite some period. You could not really hear Cedric over Victory. The gunshot was also able to be heard and shortly afterwards the victim walked outside. The struggle and arguing could still be heard going on inside and at some point Victory came outside with what appeared to be the gun in his hand. The victim did state that Victory had shot him in the audio.

I did contact the on call investigator to come to the scene which was Inv. Roubieu. Inv. Roubieu advised me he thought Cedric was a convicted felon. I did go back in and spoke with him and determined he was due to his own admission, but he advised he did not own the gun, it was his wife’s(victim). I advised him he was not allowed to be in possession of it and had Ofc Vasser handcuff him.

I was later advised after Inv. Roubieu arrived that there was possibly a gray box in the residence. Ofc Dutton stated that Victory told him that Cedric sells Ecstasy and marijuana and it was in a gray box. I went back in with Inv. Roubieu and talked with him again. Ofc Vasser did read him miranda warnings. I asked him again about who had pulled the gun due to conflicting stories. I asked him if he had pulled it due to feeling threatened in his own home and he did state that was correct, that it was him who pulled the weapon. He was also asked about drugs in the home due to the smell and that there was enough of an odor to see about a search warrant. He did state there was some, but not much and pulled out a gray foot stool that opened. He opened it and inside was marijuana in a jar, scales, a ziploc bag, some type of blue case with miscellaneous drug related items, a magazine clip and a box of ammo.

Both parties were charged in the incident. Cedric was charged at that point with the possession of the firearm and the drug charges. Victory was charged with the assault.

[NARRATIVE #5 on March 22, 2025]

On March 22nd, 2025 I Investigator Roubieu responded to [40 BLOCK] B Wood Berry Drive for reports of a female that had sustained a gun shot wound to the hand. Before my arrival Sgt. Holbrook advised that they received a call that a fight had taken place and resulted in a female [VICTIM #1] receiving an injury to her hand. He advised that it didn’t appear that she was struck with a bullet but maybe caught on the slide when the firearm was fired.

When I arrived on scene I went inside the house where Mr. Cedric Nicholson was located speaking to PFC. Vasser, I then began speaking to Cedric who I have had dealing with in the past in my time working in the jail. Cedric advised me he had just got home from the hospital and noticed that his son was still awake and should have been in bed. He also advised Nyrayah Davis was intoxicated and rubbing on his wife’s back. He advised that Victory Outley then arrived, and Mrs. Davis is the one that lets him in. He advised that Victory walked in and got in his face he advised that he and victory had gotten into it before, and victory punched him. He advised that the two then started fighting on the couch evidence of this was left behind was Victory’s Hair. I then read Cedric his Miranda Rights to which he agreed to speak to us. He stated that he did retrieve the firearm because he was scared to protect himself and his family. He advised that his Mrs. [VICTIM #1] was struck during the altercation over the gun.

I then asked Cedric about the smell of Marijuana coming from the home. To which he advised he had just what he smokes in a gray box. He then opened the gray box and advised I could look in there. I located a clear tub containing less than an OZ of suspected marijuana a scale and clear plastic baggies all in the same gray storage box in my experience individuals who have the items together partake in selling controlled substances. I also located a blue box of drug paraphernalia containing smoking devices and grinders and rolling trays. These items were taken as evidence. From my prior dealings with Mr. Nicholson I know that he is a convicted felon and is prohibited from owning or having access to firearms.

Mr. Outley advised that his daughter called him to come pick her up. She then called again asking where he was because ced was tripping out. He advised that when he arrived, he and Cedric had a conversation. He advised that he was sitting on the couch, and Cedric was standing over him being aggressive. He states that he stands up from the couch, that’s when Cedric grabs the gun from under the couch and points it at him. He advised that he, Cedric and [VICTIM #1] are all fighting over the gun. And that Cedric’s finger is in the trigger, and then the gun goes off.

Mr. Nicholson has cameras outside the residence which show Mr. Outley walking up to the door and his daughter say to come in. You then hear Mr. Outley raising his voice and being conferential you then hear a female screaming the gun go off and more screaming. You hear a female believed to be Mrs. Davis saying papa get off him and please stop Mr. Outley then walks out with the gun in his hands and states I don’t give a fu*k. He then walks back in and back out to his car. The bullet went through the kitchen cabinets and struck the water line to the sink causing the kitchen to flood. Cedric goes outside and asks for help cutting the water off to the apartment when Mr. Outley proceeds to walk towards him in an aggressive manor with his daughter having to get in front of him and stop him from confronting Cedric again.

PFC Bodenheimer then transported Mr. Outley to the Floyd County Jail on 2 counts of aggravated assault reckless conduct and disorder conduct.

PFC Vasser transported Mr. Nicholson to the Floyd County Jail for misdemeanor possession of marijuana, possession of marijuana with intent to distribute, and possession of firearm by convicted felon.
