On the above date and time I, PFC Vasser, responded to [300 BLOCK] Brumbelow Rd in regards to a male who was being evicted that was driving around the property, and causing problems. Dispatch advised as I was arriving at the residence that the male possibly had a firearm in his possession.
At approximately 2154 hours I began interviewing the residence of [300 BLOCK] Brumbelow Rd. I was advised of the following: The male next door, Dustin Kyle Tilley, was being evicted, and he was the nephew of one of the homeowners. He was driving in his car around the house and down the street super fast. He is a alcoholic. They heard something on the side of the house, but they were not sure if that was him or not.
I asked the complainants what kind of car Dustin was driving and they advised that it was a smaller gray car. I seen a car next door that matched what they were telling me, and I asked them if that was it, and they confirmed that it was the vehicle that Dustin was driving.
Due to being advised that Dustin might have a gun I began looking to see if I could find him. At this time PFC Flippo arrived on scene. We both then went next door to where I was advised that Dustin was living. As we approached the residence of [300 BLOCK] Brumbelow Rd, Dustin and his wife, [WITNESS #1], came outside. As Dustin came down the stairs to speak with me I observed that he had glassey blood shot eyes, a strong smell of a alcoholic beverage emitting from him, slurred speech, and trouble keeping his balance. Dustin approached me with his hands up and then he lifted his shirt to show he had no weapons which is unusual behavior for someone speaking with me. I advised Dustin to sit on the hood of his car so he wouldn’t fall over, and for him to explain to me what was going on between him and the neighbor. He advised the following: His aunt was evicting him, and he had only 3 days to leave. He didn’t do anything wrong, and that he had text messages from his aunt.
I asked Dustin why he was driving his car through the yard and he advised that he had not left the house. I then went and spoke with [WITNESS #1] who advised that Dustin had driven the vehicle around their yard and at his aunts residence next door. She advised that he was very intoxicated, but was hurt because of what his aunt was doing to him. She advised that it was about an hour since he had been driving the car around the yard. I then asked Dustin again about driving the vehicle, and he advised that he drove the vehicle around his yard and no where else. Dustin was asked how many beers he had, and he first advised that he had 10 beers. He then advised that he had 8 beer and smoked marijuana about 15 minutes ago.
I asked Dustin if he would preform Field Sobriety Test and he refused. He advised that his uncle was a lawyer, and that he knows his rights. I then asked him if he would be willing to blow into a Preliminary Breath Test and he refused. I advised [WITNESS #1] that Dustin would be going to jail, and how the eviction process worked for future reference. Dustin was then placed into handcuffs. The handcuffs were checked for proper fitting and double locking in accordance with department policy.
I then spoke with complainants and advised them of what was going on, and the proper eviction process. I then moved my patrol vehicle from [300 BLOCK] Brumbelow to [300 BLOCK] Brumbelow to place Dustin in the back. Dustin was read the Miranda Warning where he refused to speak with me. Dustin was then read the Georgia Implied Consent Notice where he refused to submit to the state chemical test of his blood. I place a seat belt on Dustin then began transporting him to the Floyd County Jail.
While en-route to the jail Dustin began complaining that his hands were hurting him. I stopped my vehicle at Wax Rd and Harmony Rd to get Dustin out of the vehicle. I placed the handcuffs in the front of Dustin’s body due to swelling in his hands possibly due to the alcohol, and I checked them for proper fit and double locking in accordance with department policy. While en-route to the jail Dustin advised that he had to use the restroom. I had advised Dustin before we left his residence that he would have to wait until we got to the jail. While going down the road Dustin began undoing his pants and standing up in the back seat of my patrol car trying to urinate in my backseat. I advised Dustin that if he didn’t sit down a cooperate that I would be forced to place his handcuffs back behind his back. Dustin then sat back down until we arrived at the jail for him to be booked.
