On Thursday, March 27th, 2025, at approximately 10:12 hours I, Officer Gibbs, responded to the area of E 10th St regarding the complainant wanting to meet with an officer in reference to a subject pointing a gun at him. On scene I met with [VICTIM #1] who advised me of ongoing issues with Erian Wiggins (2501850RPD). He then stated Mr. Wiggins had pointed a gun at him in front of a store, which he then described and I recognized to be Lambert’s on E 14th St. He was unable to describe the firearm. He also requested to press charges and stated this incident occurred approximately an hour prior. While we were walking away, [VICTIM #1] pointed out two subjects walking on Maple and stated one of them was Erian.

We then met with Erian who similarly advised of ongoing issues between the parties. He stated this morning, they were in an argument over property. He then went to wait for a ride from his mom outside Lambert’s when [VICTIM #1] approached him, trying to fight. He also explained of a prior injury to his Achilles tendon, expressing concern of further injury should he be involved in a physical altercation. Erian then admitted to brandishing the firearm, explaining and demonstrating that he was pointing it at the ground while warning [VICTIM #1] not to approach him. [VICTIM #1] then walked around Erian, who then holstered his weapon.

When asked about his weapon, he indicated it was in his waistband. I advised him to raise his arms, and he allowed me to retrieve it. The firearm was identified as a Taurus GX2 bearing serial number AGN675120, which returned through NCIC as having no record. The firearm and magazine with 9mm rounds (x13) were later turned into evidence.

I then went to Lambert’s to review possible surveillance footage. The clerk allowed me to view it but stated someone else would have to provide a copy. He attempted to call someone who may be able to, but they did not answer. The footage from my viewpoint was captured on my body camera. The footage did not capture audio but depicted Erian in the roadway on Spring Creek, near its intersection with E 14th. [VICTIM #1] is seen walking West on E 14th St, approaching the intersection, where Erian is standing.

There was nothing about [VICTIM #1]’s behavior that was aggressive. He did not charge, lunge, or run toward Erian nor did he assume any sort of fighting stance. Erian then presents a firearm, as [VICTIM #1] approaches, and holds it straight out (his arm was parallel to the ground) and aims it at [VICTIM #1]. [VICTIM #1] then crosses the street, which Erian continues to track him with the firearm. Once [VICTIM #1] passes the intersection, Erian holsters his firearm.

Due to the video and corroborating testimony, absent of other witnesses or other evidence, I returned and placed Erian under arrest in handcuffs which were checked for fit and double locked. He was then searched and placed in the rear passenger compartment of my patrol vehicle which was checked prior to and following his tranpsort to Floyd County Jail. He was booked in without incident.
