[NARRATIVE #1 on June 21, 2026]

On June 21, 2026 at approximately 1218 hours, I (PFC Blankenship) was dispatched to the area near 103 Hicks Dr (Home Depot) in reference to a male possibly armed with a firearm threatening the complainant and his family. The male was described as Hispanic wearing a black jacket with a bicycle.

Upon arrival to the area, I observed a male matching the above description pushing a bicycle up the sidewalk eastbound in front of the East Bend Shopping Center. I made contact with the male and he identified himself as Javier Manuel Hernandez. Javier advised that nothing had happened over at Home Depot and then made statements advising that a male had come at him and that he had been trying to get away. He denied making any kind of threats toward the other party. I then detained Javier and placed him into handcuffs and patted him down for weapons. No firearm was found, but I did remove a box cutter that was hanging around a necklace on his chest.

OFC Chaves made initial contact with complainants and identified them as [VICTIM #1] and his wife, [VICTIM #2]. When I interviewed [VICTIM #1], he advised that he had been with his wife [VICTIM #2] and their 10 y/o son [REDACTED BY AGENCY] when Javier had begun to accost them and yell toward them. He advised that Javier began to make vulgar and sexual comments toward his wife and in the presence of their child. [VICTIM #1] confronted Javier and Javier then began to yell at [VICTIM #1] and made statements to include “I’ll f*cking kill you”, “I’ll crack your head open and turn it inside out”, and “I’ll f*ck your wife and her thick a*s”.

I spoke with [VICTIM #2] as well who advised that Javier had been yelling and making obscene statements toward her and about her that she didn’t like. She advised that she had begun to move herself and her son away from Javier out of fear from his actions and words toward them. She advised that she told her husband, [VICTIM #1], to be careful as they didn’t know if Javier had a gun on him. She advised that Javier then partially lifted up his shirt and acted as if he was carrying a firearm.

I then spoke with their 10 y/o son, [REDACTED BY AGENCY] who advised that Javier was “acting crazy and saying bad words”.

Ofc Chaves further spoke with an employee of Home Depot ([WITNESS #1]) who observed the above incident. See supplemental narrative for further.

Due to the testimony of Javier placing him in the vicinity and having a confrontation with [VICTIM #1] and his family and the testimonies of [VICTIM #1], [VICTIM #2], and their son, I place Javier under arrest. He was fitted with handcuffs (fit and double locked) and placed into the rear of my patrol car. A search incident to arrest further yielded a suspected high THC vape pen that will be submitted into evidence at the Rome Police Department and sent for testing.

Prior to being placed under arrest, Javier had been read his rights under Miranda. When asked about the vape pen, he advised that it was THC that he had bought from a store. A search under the vape pen’s branding showed advertisements for the vape pen as having the potency and content of 0.5 gram of marijuana in one pen.

Javier was transported to the Floyd County Jail where he was booked in on his charges.

[NARRATIVE #2 on June 21, 2026]

On Sunday 6/21/2026 I, Ofc Chaves went to assist PFC Blankenship with a fight call that was in the area of the Home Depot on Hicks Dr.

PFC Blankenship was able to observe the subject dispatch described involved in the fight on Turner McCall by Chipotle. Upon my arrival, Javier Hernandez was was placed in handcuffs due to him possibly being armed. PFC Blankenship relayed Javier’s name and date of birth to dispatch and dispatch advised that Javier had two warrants; 1 out of California and another out of South Carolina.

I then spoke to the complainant on the phone, [VICTIM #1]. [VICTIM #1] advised that him and his wife and kid were walking toward the entrance of Home Depot when Javier began screaming vulgarities toward Mrs. [VICTIM #2]. [VICTIM #1] stated he then told Javier to “shut the f*ck up” and walked toward him as Javier yelled back “I’ll f*cking kill you.” [VICTIM #1] stated he was going to go confront Javier when his wife held him back and told him not to because he may have a firearm. [VICTIM #1] stated he never actually saw a firearm but stated when Javier was getting onto his bicycle he pulled up his shirt and [VICTIM #1] stated he saw something black like maybe a phone or firearm.

I then spoke to [REDACTED]. Mr. [REDACTED] stated he was working outside when he heard Javier yelling “b*tch” and other vulgarities toward a woman (Mrs. [VICTIM #2]) Mr. [REDACTED] stated he saw Javier acting irrational and saw [VICTIM #1] about to go toward Javier. Mr. [REDACTED] stated he did not observe any firearm or hear anything else after Javier got on his bicycle and left toward Texas Roadhouse. Mr. [REDACTED] stated he then continued to work like normal.

Sgt. Rast then arrived on scene and advised me that Javier was being placed under arrest. I then searched incident to arrest Javier and placed him in the rear seat of PFC Blankenship’s vehicle.

I then went back to Home Depot to try and recover video footage, however the employees advised the only person who can retrieve footage would be [REDACTED] (district asset protection). I tried to contact [REDACTED] by phone however there was no answer. An axon request will be sent to his phone number in hopes of him sending any video footage.
