On 6/20/2026, I (Lt. Clayton) responded to a domestic altercation in the area of Grandberry Court and Willow Run Drive. while en route to the call we were advised that the female had gotten away from the male, who was still at the vehicle they were in and that there were two kids with the male and that there was a gun in the vehicle and they heard one person telling others to not go near the vehicle and that there was a gun in the car.
As I approached Willow Run Drive I observed two vehicles parked at the intersection with Billy Pyle Road and a black male was at the passenger side of the an SUV near the stop sign with the passenger side door opened. I positioned my vehicle behind both vehicles and began to approach the SUV in the front and the male at the passenger side began to approach me, telling me that he did not want anyone to get harmed and that there was a lot going on.
I advised him that I was here now and that I needed to talk to the male in the vehicle and the male, who I identified himself as “[WITNESS #1]” kept telling me to let him talk to him. I asked “[WITNESS #1]” to ask the male to step out of the vehicle and to come and talk with me and he approached the car and began to talk with the male again. I began to position myself to see what was going on inside the vehicle and observed a male holding a small child in the driver seat of the vehicle and he was visibly upset. I did not see any weapons in the males hands and [WITNESS #1] continued to talk to him and he began to open the drivers door.
I went to the back of the vehicle and saw that he was exiting the vehicle and still had the small child in his hands and he approached the rear of the vehicle and handed the baby to [WITNESS #1]. Mr. Mitchell then began to walk quickly toward my vehicle putting his hands behind his back and telling me lets just go. Mr. Mitchell got to the other vehicle that was parked behind the SUV and he leaned up against the vehicle and I asked him to tell me what was going on.
Mr. Mitchell began to speak but would not tell me what was going on. Mr. Mitchell began to get in my face and I pushed him back toward the car and then he put his arms around me and I took control of his arms and with the assistance of Sgt. Wade we turned the male around and I placed him into handcuffs and secured him at that time based on his demeanor. Mr. Mitchell then stated that he did not want to tell us what was going on and I searched him for weapons, double locked the cuffs and secured him in the back of my vehicle based on his demeanor, there was also a strong odor of alcohol coming from him.
Several females had walked up and one was visibly upset and crying and I identified her as Mrs. [VICTIM #1]. Mrs. [VICTIM #1] stated that they had been at a friends house playing games, later advising that it was a drinking game. Mrs. [VICTIM #1] stated that they began to argue about her asking if the dogs needed to go out and he started to become aggressive. Mrs. [VICTIM #1] stated that she decided that they should leave at that point and she began to load up the kids and she was able to find the keys and they left their friends residence.
Mrs. [VICTIM #1] stated that after they left it was quite at first then he began to hit her window and she was scared he was going to try to grab the steering wheel so she stopped the vehicle. She stated that she took her seatbelt off because she felt that she needed to jump out of the car and she advised that when she tried to get out of the car he grabbed her by the hair, pulling some of her hair out, which she had a large clump of hair in her hand. She advised that she took the keys when she left the vehicle, but that he still had the kids in the car with him.
I had Mrs. [VICTIM #1] as well as two other females give a written statement about what had occurred and the statements all detailed Mr. Mitchell becoming physical with Mrs. [VICTIM #1] at the residence and one advised that they had seen Mr. Mitchell grab Mrs. [VICTIM #1] by the throat at one point.
Based on the statements of the witnesses, victim, and the evidence at the scene I placed Mr. Mitchell into custody for the listed charges. Mr. Mitchell was searched thoroughly and transported to the Floyd County Jail without further incident.
