On 07-26-2026 at 2258 hours, I (Officer Shaw) responded to a domestic dispute at [SINGLE DIGIT BLOCK] Wentworth PL. At 2310 hours I arrived on scene and made contact with Mark Mcgill Espy.

Mark, 51 year old male, stated that he wanted to use his mother’s car to go to the store, she did not allow him to use the car and he got upset. He claimed that he was yelling but never made physical contact with his mother. Mark claimed that his truck was out of service and needed to use her car in order to go out, he did not want to be in the house and refused to walk to the store due to the humidity outside.

I then made contact with his mother, [VICTIM #1]. She informed me that Mark had come into the living room, where [VICTIM #1] was sleeping, and woke her up demanding the keys to her car. She stated that she refused to give him the keys due to him smoking cigarettes in the car and trashing the inside. [VICTIM #1] stated that Mark began to get upset and began to yell at her, even getting in her face, and at one point he hit the top of her head with his chin. She stated that she was in fear for her safety, she was scared and visibly upset due to the whole situation.

I approached Mark, who was outside, and told him to stand up and to place his hands behind his back. I informed Mark that he was under arrest, I applied my handcuffs to Mark’s wrist, checked them for fit, and double locked them. I then took mark to the back of my patrol vehicle, searched him incident to arrest, and placed him in the back seat. I rolled the back window down and read Mark his miranda rights, Mark then stated he did not hit the top of her head with his chin, he did not mean to place her in fear, and that he did in fact yell at her.

Mark was curious at to what his charges would be, I informed him he was under arrest for Simple Batter (FVA) for her claim of him hitting her with his chin, and Elder Abuse (Misdemeanor) due to him intimidating her by screaming at her, inches from her face, in order to get her keys for her car.

A victim notification form was filled out, Mark was transported to the Floyd County Jail without incident, and turned over to deputies at the jail.
