On April 2, 2026, PFC Roden and Officer Valentine were dispatched to [800 BLOCK] Avenue B, Apartment #[REDACTED], in reference to an initial report of a fight that was later determined to involve a theft. The complainant, [VICTIM #1], reported that a male identified as Michael Foster had taken his medications. Mr. [VICTIM #1] stated that the suspect had a visible knife in his pocket but did not brandish it. He further advised that the suspect had left the scene prior to officers’ arrival.
Upon arrival in the area, I observed a male walking along Avenue B toward 507 Turner McCall Boulevard. Officer Valentine made contact with an individual who advised that the subject we were seeking was inside the Chevron. A male matching the description, with a visible knife, was observed standing in front of the store. I made contact with the individual and asked his name; he identified himself as Michael. When asked if he was Michael Foster, he confirmed his identity.
Mr. Foster was questioned about the incident and stated that Mr. [VICTIM #1] was upset with him, believing that he had stolen money. He also acknowledged that Mr. [VICTIM #1] had accused him of taking prescription medication. Mr. Foster denied taking any property from Mr. [VICTIM #1].
I requested consent to search Mr. Foster’s person, which he granted. Officer Valentine conducted the search and located a green pill bottle with the label removed. Mr. Foster claimed the bottle contained his prescription medication. I then requested that dispatch contact Mr. [VICTIM #1] to obtain a detailed description of the stolen bottle. Dispatch advised that Mr. [VICTIM #1] described the bottle as green, which was consistent with the bottle recovered from Mr. Foster.
Mr. Foster was subsequently detained. I transported the bottle to Mr. [VICTIM #1]’s apartment for comparison with his remaining prescription bottles. The recovered bottle matched the others, including the specific script on the cap. Mr. [VICTIM #1] stated that the medication in the bottle was Cyclobenzaprine, a muscle relaxant prescribed for pain management, and that approximately five pills were inside at the time it was taken.
Based on Mr. [VICTIM #1]’s accurate description of Mr. Foster, Mr. Foster’s admission that he had been at the apartment, and the positive identification of the prescription bottle, probable cause was established for Mr. Foster’s arrest. Officer Valentine transported Mr. Foster to the Floyd County Jail.
Due to the nature of the medication and the impact its absence would have on Mr. [VICTIM #1]’s physical and mental well-being, Mr. Foster is being charged with exploitation of an elder person.
