On the date and time listed above I, CPL. J. BODENHEIMER, was dispatched to the above address in reference to a physical domestic that had already occurred. Prior to arrival I was notified by Dispatch that the victim had left her residence and was waiting for Police at [REDACTED]. I went and spoke with the victim, [VICTIM #1], first.
[VICTIM #1] advised me that her and her grandmother, PATRICIA GONZALEZ, had gotten into an argument because [VICTIM #1] had left PATRICIA’s phone at her girlfriends house. [VICTIM #1] stated that she went back to get her phone and before she could get back home PATRICIA met her outside and began yelling at her. [VICTIM #1] stated she went inside the residence at [REDACTED] where they live together. [VICTIM #1] said that when they got inside PATRICIA got in her face and yelling at her and when she went to walk away PATRICIA grabbed her by the hair and began pulling her head backward. [VICTIM #1] then grabbed PATRICIA near her neck to try and get her off of her and when she did this PATRICIA grabbed her by her left arm and left a visible red mark on her left forearm.
I then went to [REDACTED] to speak with PATRICIA. Once there I asked PATRICIA to come outside to speak with me. PATRICIA uses a walker/cane/wheelchair to get around because of some medical conditions so I allowed her to sit in a walker that was just outside the front door. I then asked PATRICIA what had occurred and she stated that for the past week she had been allowing [VICTIM #1] to use her phone at times and that all week [VICTIM #1] had her phone and would not give it back. PATRICIA stated that she had gotten frustrated with [VICTIM #1] and began yelling at her because she had left it at her girlfriends house.
PATRICIA went on to say that they went inside the residence and PATRICIA admitted to getting in [VICTIM #1]’s face and they began yelling at one another. PATRICIA stated that when [VICTIM #1] went to walk away she grabbed her by the hair and began pulling on it. PATRICIA then admitted to grabbing onto [VICTIM #1]’s arm when she put her hand on her neck. I asked PATRICIA if she felt that that was the right thing to do and she admitted to knowing that she should not have done that.
Based on PATRICIA’s admission of pulling [VICTIM #1]’s hair and grabbing [VICTIM #1]’s arm I informed PATRICIA she was under arrest for Cruelty to Children in the 1st Degree F.V.A. and Simple Battery F.V.A.,. I then helped PATRICIA walk to Sgt. Forrister’s Patrol Car where she placed in the backseat. Due to PATRCIA’s medical conditions and limited mobility PATRICIA was not placed in handcuffs. PATRICIA was transported to Floyd County Jail where she was Medically Cleared and taken into custody by Jail staff.
