WILLFUL OBSTRUCTION OF LAW ENFORCEMENT OFFICERS – MISDEMEANOR

On Sundey August 23rd 2026 at approximately 1911 hours, I Pfc Wilbanks (RPD75) responded to 825 Cartersville Hwy in reference to a private lot wreck. Once on scene I saw that one of the vehicles was still blocking the isle in the parking lot. I instructed the parties to pull into a parking spaces to free up the parking lot.

As the parties involved did this, a white male wearing a tacobell T shirt began walking up to my car. I spoke with the male and he told me who caused the collision. I advised him that I would be completing a report for the parties involved but it would not be up to me to determine who was at fault due to the collision occurring on private property.

I noticed the male was becoming irate as he began telling me to go home. I thought this was odd as he was not involved in the collision. I exited my vehicle and spoke further with him attempting to explain that it was on private property and how police deal with private lot wrecks. The male would not listen to me and continued to argue. He did advise that he wanted to be a witness. I advised him that he could and to wait and I would get his information.

As I gathered the involved parties information the male continued to be confrontational with me. I attempted to work past it. As I was speaking further with Ms. [WITNESS #1], the male then state to me that I “changed the scene” when I told the cars to park and that I could not do that. He then told me “I understand everything about a cop, I’m a cop”. I asked “are you a cop”. He responded “yes, I don’t ride around like that” as he made a pointing motion toward me.

I asked what agency he worked for. He stated that “one of yall stole my badge” and “Cherokee County Multi Agency Task Force”. I asked to see his credentials. He stated that he didn’t have a badge and that someone stole it. The male then continued to argue. I told the male several times to go as I pointed him away from the scene. He continued to argue and did not leave as I instructed.

I then walked toward the male and told him to turn around and put his hands behind his back. He did not do as I asked. I grabbed his right wrist and placed a handcuff on it. As I did he told me that he would “take that badge before I die” as he balled up his left fist holding it back and shaking it at me. I immediately noticed his fist. Fearing I was about to be punched, I pushed it away with my left hand. I then grabbed the male by his left shoulder, spinning him around where I grabbed his left arm and placed it behind his back. His left wrist was placed in the other handcuff without incident.

I walked the male to my car where he was placed in the back seat. Soon Ofr Cook arrived on scene to assist me. Due to me arresting the male, Ofr Cook advised that he would complete the private lot wreck report. The male was identified as Randy Love. Prior to leaving the scene, I noticed that Mr. Love was bleeding from his right wrist. I checked the right cuff on Mr. Loves wrist and noticed that I was able to fit my right index finger between the cuff and his wrist. I saw the Mr. Love had a cut mark on his right wrist. Due to this I loosened the cuff a little more.

Mr. Love was transported to the Floyd County Jail and booked in. Pictures of Mr. Loves wrist were taken and will be attached to this report. Upon reviewing body-camera of the incident, Mr Love’s arm was not bleeding when I placed him in handcuffs nor when he was placed in the rear of my patrol vehicle.
