[NARRATIVE #1 on June 21, 2026]

On the above date and time, I CPL Doan responded to the “Racetrac” gas station located at 3006 Martha Berry highway due to a silent alarm being triggered. While Enroute to the location, E-911 Dispatch advised responding units that an employee at the location had triggered it on purpose due to there being an irate male in the building whom was intoxicated and acting erratic to the point that they were not feeling safe.

Upon my arrival, Lt. Williams was on scene and I was able to observe him walking the male out of the side door which faces the Armuchee Connector on the south end of the building. I quickly followed in after him and observed a large male beginning to exit the building and initially complying with Lt. Williams’s commands. As I was following Lt. Williams and the male out of the building, he turned and began saying that he “wanted to go to the bathroom”.

We advised him that he was not allowed to and needed to leave the property immediately due to management wanting him banned/escorted from the premises due to his boisterous and vulgar actions toward the employees inside of the store. He then exited the store and in doing so turned and faced myself and Lt. Williams in the awning/breezeway portion of the store where he began speaking. Up until this point, I had not observed any indication of violence and he appeared to be calm but frustrated. He then placed his right hand in his right pocket and in doing so, I instructed him to remove his hand from his pocket.

The male then became irate in an instant and began yelling and tensing his body toward officers. I then reached for his wrist due to it still being inside of his right pocket after him yelling and becoming agitated by the simple command and in doing so, he jerked backward and it finally came out of the pocket where he yelled “it was never in my pocket, its just my wallet!” It was at this point in time I was able to observe the odor of an intoxicating substance emanating from his breath.

He then stated that he did not want to talk to me and began speaking with Lt. Williams again and in doing so he was instructed to leave. I respected his wishes and did not interrupt him speaking with Lt. Williams in an attempt to deescalate the situation. He then began walking away and reached the center of the parking lot while speaking loudly to himself. He then became irate once more without provocation and began yelling about gang affiliation and using vulgarities in the public area while walking back toward the entrance of the store.

Due to the observed OCGA violations of Disorderly conduct (16-11-39 Acts in a violent or tumultuous manner toward another person whereby such person is placed in reasonable fear of the safety of such person’s life, limb, or health), Public Drunk (16-11-41 A person who shall be and appear in an intoxicated condition in any public place or within the curtilage of any private residence not his own other than by invitation of the owner or lawful occupant, which condition is made manifest by boisterousness, by indecent condition or act, or by vulgar, profane, loud, or unbecoming language) and Criminal trespass(16-11-21 Remains upon the land or premises of another person or within the vehicle, railroad car, aircraft, or watercraft of another person after receiving notice from the owner, rightful occupant, or, upon proper identification, an authorized representative of the owner or rightful occupant to depart) at this time, it was decided to place the male under arrest for the above offenses.

Lt. Williams and myself then began approaching the male in order to effect and arrest however up approach, the male began turning and walking away. Due to the large size of the male, his disregard of commands and him “taking flight” by walking away from Officers, the use of “soft hands” was not possible at this time due to his irate/combative demeanor. Lt. Williams and myself chose to utilize to our Taser energy weapons at this time in order to safely effect the arrest.

While giving commands, Lt. Clayton arrived on scene and advised the male that he was under arrest as well however commands were ignored once more and he began heading back toward the sidewalk of the property. Almost simultaneously, Lt. Williams and myself deployed our Taser energy weapons. Due to the simultaneous deployment, it is suspected that the wires attached to the probes touched each other thus rendering the deployment ineffective and the male remained standing. I then reloaded my cartridge and at this time, Lt. Clayton resorted to a take down of the male.

Once on the ground, I holstered my Taser energy weapon and began attempted to assist in placing the male into handcuffs. The male then tensed his arms and tucked them under his body in an attempt to prevent handcuffing while screaming, cursing and threatening Officer’s. During the struggle, I positioned my forearm at the top of his back/bottom of the neck (near the top of the “trap” muscle) in an attempt to gain control of the irate male that was attempting to thrash and resist arrest the several other Officer’s that were having difficulty gaining control of the subject due to his mass. The male stated that “I can’t breathe” at this time and so I immediately repositioned my placement. Once in handcuffs, he was positioned in a seated position to better open his airways on the curb due to him complaining of his breathing still.

EMS was contacted for his complaints of injury, probe removal and his request. EMS arrived on scene and the male now identified as Ray Mack began verbally abusing them as well. It was at this time I went to retrieve my patrol vehicle in order to transport Mr. Mack. While walking to my car, I observed a van which was parked in front of the doorway to the store and asked him if he knew Mr. Mack due to Mr. Mack having approached him while walking toward the parking lot. He stated that he did not know him however heard him yelling about being “from California and being a Crip Gang member” along with other yelling.

I then retrieved my vehicle and went to Mr. Mack and the other Officer’s. Mr. Mack continuously stated that he wished to go to the hospital and wanted to ride with the ambulance to avoid arrest. Mr. Mack was then escorted to the back of my patrol vehicle after adjusting his handcuffs due to them having tightened during the struggle. He continuously “attempted” to get into the back of my patrol vehicle where we assisted him into it. Once in, I transported Mr. Mack to Redmond hospital per his request for medical treatment.

Upon arrival at Redmond hospital, Mr. Mack was escorted into the Hospital. Once inside, Mr. Mack pretended to “faint” where I had to catch him from falling. He was then placed into a wheel chair when he stated that his “legs weren’t working”. I attempted to push the wheel chair he was in toward the room they had designated for him however he was refusing to pick up his legs in order for me to do so. I then had to drag the wheelchair back wards and in doing so, Mr. Mack started sliding his body out of the chair in order to fall onto the floor.

Prior to falling, we had to catch him and place him back into the chair. Once outside of his room, Mr. Mack stated that he was unable to stand up and get into the bed. After some talking, Mr. Mack was able to stand up and use his legs with ease where he sat on the bed without any difficulty. Mr. Mack was then wheeled into the room on the bed and Hospital staff began attempting to get his vitals. During this process, Mr. Mack repeatedly moved and attempted to take the pressure cuff off in order to prolong the process and or be admitted to avoid Jail. While speaking with Mr. Mack he had asked me what his charges were to which I advised him they were all misdemeanors at this time.

The Doctors were finally able to clear Mr. Mack and as a result Mr. Mack became irate again and began shaking the hospital bed with such force it lifted from the ground. I was able to calm Mr. Mack down once more and as a result, we were able to escort him from the property and back into my patrol vehicle. He was then transported to Floyd County Jail without further incident.

While at the Jail, I was made aware that Lt. Clayton had received an injury in the physical altercation at the Racetrac which I had not known prior.

[NARRATIVE #2 on June 21, 2026]

On 6/21/2026, I (Lt. Clayton) responded to the Race Trac located at 3006 Martha Berry Highway in reference to a Armed Robbery Alarm and subsequent call about an intoxicated individual causing a disturbance at that location.

Upon my arrival several other officers had already arrived and as I was trying to locate them I heard screaming coming from the side of the building and began to go toward the screaming. I observed a black male screaming and officers trying to stop him, with the male beginning to walk away from officers, while they were giving him verbal commands to stop and that he was under arrest and he continued to walk away from officers and scream.

I got in front of the male and advised him that he was under arrest and he began to run between me and the other officers toward the store again and Lt. Williams and PFC Doan discharged their taser at the male and he showed little compliance to the taser and turned toward us and took what I perceived to be a fighting stance, while pulling up his pants. During this officers were continually giving him commands to get on the ground, however he refused to do so.

I approached the male and grabbed him by the arm and around his torso and took him to the ground, while maintaining control of one his arms with the help of several officers we were able to secure him in one handcuff and roll him to his stomach, where he was secured in another cuff. The male was verbally screaming and cussing throughout the altercation and began to say he could not breath, the male was assisted to a seated position and still complained of not being able to breath and EMS was requested to the location.

The male complained of his wrists and arms being in pain and the cuffs were checked and due to him fighting during his detention and subsequent rolling the cuffs were exchanged, with two pair being used, due to the size of the male. The male was verbally abusive to EMS personnel and would not cooperate with them as well. He was escorted to the back of PFC Doan’s patrol vehicle where he continued to state he wanted to go to the hospital he eventually spoke with EMS, but only told them he had pain all over.

Based on the demeanor of the male I had PFC Doan and PFC Wishart transport him to the hospital due to his complaint of injuries. Prior to him leaving the scene I attempted to get pictures of his injuries, which included skinned elbows and puncture marks from the taser probes, which were no longer present in his body. During the altercation I received an injury to my left elbow from the contact with the ground, a picture was taken of that as well and added to the report.
