[NARRATIVE #1 on May 04, 2026]

On 05/04/2026 at approximately 15:01 hours, I, PFC B. Smith, was on duty, in full uniform, and operating a fully marked patrol vehicle when I was notified by E911 of a call at Johnson Elementary School regarding a female reportedly asleep behind the wheel of a vehicle in the school pickup line. School staff stated they had a hard time waking her up. E911 further advised that school staff reported the vehicle emitted an odor consistent with marijuana.

The BOLO advised that a female driver operating a gold Chevrolet Malibu bearing Georgia license plate [REDACTED] had reportedly fallen asleep while stopped in the school pickup line and subsequently left the school with juvenile passengers still inside the vehicle. Due to the reported behavior, there was concern the driver may be impaired or otherwise unable to safely operate the vehicle.

I responded to the area, and while en route, I observed the described vehicle traveling on SR 1 Loop near Calhoun Road. I turned around, caught up to the vehicle, and initiated a traffic stop to investigate the reported impairment. The vehicle came to a stop at Trinity Church on Calhoun Rd. I was abel to verify the tag number was the same as the school gave E911.

Upon making contact with the driver, identified as Sheralyn Curtis, I immediately detected a strong odor of burnt marijuana emitting from inside the vehicle. I also detected the odor of what I recognized through my training and experience to be a marijuana odor-masking spray commonly referred to as “blunt spray,” which is frequently used to conceal the odor of marijuana inside vehicles.

Upon speaking with Curtis, I observed her speech to be slurred. Her responses to my questions were delayed, and she appeared confused and disoriented during the interaction. I further observed Curtis to have pinpoint pupils, visible eyelid tremors, and trembling hands.

I am not currently certified in Standardized Field Sobriety Testing (SFST) or Advanced Roadside Impaired Driving Enforcement (ARIDE), and I did not administer standardized field sobriety evaluations. I requested another officer respond to perform SFST on Curtis, See Supplemental Narrative for further. The observations noted above, including Curtis’s slurred speech, apparent disorientation, pinpoint pupils, eyelid tremors, and trembling hands, are based on my direct observations and are documented as indicators of possible impairment.

Based on the BOLO information indicating Curtis had reportedly been asleep behind the wheel in the school pickup line, the presence of juvenile passengers in the vehicle, the strong odor of burnt marijuana, and my observations of her physical condition and demeanor, I suspected Curtis was operating a motor vehicle while under the influence of drugs to the extent it was less safe for her to drive.

I made the decision at this point to place Curtis under arrest for DUI Less Safe as well as DUI Child Endangerment due to her (2) kids under the age of 14 being in the vehicle. I placed her into handcuffs, behind the back, double locked and checking for proper fit. As I was doing so, she began to attempt to pull away from me and also refused to comply with commands.

I read her the Georgia Implied Consent Notice and requested her blood, to which she refused. She informed me that I was not allowed to arrest her because she has seizures and normally does not drive because she is not safely able to. She did state she knew if she gave me her blood then it would show positive for marijuana but she had not smoked any on this day. She also takes a large amount of prescription medicines which she stated she probably should not drive on, but she just needed to go get her kids.

I transported her to the Floyd County Jail where she was medically cleared and booked in.

[NARRATIVE #2 on May 04, 2026]

On the date and time listed above I, PFC. J. BODENHEIMER, received a phone call from PFC. SMITH asking me to come and perform Standardized Field Sobriety Testing (SFST) on a female that he had pulled over that he suspected to be under the influence of Marijuana. I told him that I would be en route to his location.

Upon arrival I immediately walked up to SHERALYN CURTIS and asked her if she would be willing to conduct SFST and she said she would. SHERALYN was wearing glasses and I asked her if she could take them off and she said she could but that she was “blind” and stated that she was nearsighted. I raised my right Index finger in front of her and asked if she could see it and she stated that she could.

I then asked her if she had had any head injuries and she stated that she did. SHERALYN said that she had a head injury twelve years ago and then one also ten years ago. I then asked her if she took any prescription medication and she stated that she did. SHERALYN stated that she was taking VIMPAT 150mg, TOPOMAX 50mg, and an antidepressant that she could not remember the name of. SHERALYN said that she takes the VIMPAT and TOPOMAX twice daily at 10AM and 10PM and the antidepressant at 10PM everyday.

I asked SHERALYN if she took anything else and she stated that she takes a bunch of vitamins but nothing prescription beside what she had already told me about. SHERALYN did add that she use to smoke Marijuana but that she stopped about two weeks ago. SHERALYN also added that before she stopped she would smoke daily if not more frequently.

While speaking with SHERALYN I noticed that she had blues eyes, that were normal size, and was squinting a lot from the sunlight. I changed positions with SHERALYN to see if that would help but it did not. I noticed that there was an awning at the church where PFC. SMITH had stopped her at and I asked SHERALYN to walk over there to conduct SFST. SHERALYN agreed and walked over with me. Once we were in some shade I told SHERALYN to stand there with her feet together and her arms by her side to get her into the starting position for Horizontal Gaze Nystagmus (HGN).

SHERALYN asked if she could take her shoes off to help her balance easier and I told her that was fine. I then began the HGN test by making two passes on each eye checking Equal Size and Equal Tracking. Once complete I then moved into the first phase of the test: Lack of Smooth Pursuit. I made two passes on each eye and received no indicators.

I then moved into the next phase of the test: Distinct and Sustained Nystagmus at Maximum Deviation. I made two passes on each eye and received no indicators.

I then moved into the final phase of the test: Onset of Nystagmus Prior to 45 Degrees. I made two passes on each eye and received no indicators.

I then asked SHERALYN if she would mind doing some more testing and she stated that she would. I asked SHERALYN if she had anything wrong with her legs, walking and balancing. SHERALYN stated that she did because she had broken her neck and back but SHERALYN said that she was willing to try. I instructed SHERALYN into the starting position for the Walk and Turn and she was unable to stay in the starting position due to her balance.

I asked SHERALYN if she would be willing to do the One Leg Stand and she said that she would. I told SHERALYN to put her feet together and arms by her side and to stay in that position until I told her to begin the test. I then demonstrated the test for her and once I was ready I told her to begin.

SHERALYN began the test by raising a foot of the ground and immediately lost her balance. SHERALYN then immediately raised her other leg approximately two inches off the ground and I restarted the the 30second time for the test. SHERALYN gave 1 clue for the test when she raised her Left Arm for balance.

Once all testing was completed I told SHERALYN to go stand in front of PFC. SMITH’s patrol car. I then pulled PFC. SMITH to the side and informed him that throughout the testing I only received one clue and that it was on the One Leg Stand test. PFC. SMITH then asked if Marijuana use would show on HGN and I stated that it would not. I told PFC. SMITH that if he felt he had enough for an arrest that it was up to him.

PFC. SMITH then placed SHERALYN under arrest by placing her in handcuffs without further incident. PFC. SMITH read SHERALYN Georgia’s Implied Consent for blood and she refused. SHERALYN was placed in the back of patrol car #40 and transported to Floyd Coutny Jail.
