On the above date and time, I CPL Doan responded to the above lsited address in reference to a domestic altercation which was occurring between a husband and wife.
Upon arrival to the residence, I was able to observe a male with a cane standing outside of the housing units and as a result, I approached him and began asking him what had occurred. He identified himself as Herrera and stated that he and his wife were arguing about an altercation between he and his son the previous night.
Herrera stated that he and his son had been arguing due to his unruly attitude and as a result it ended up getting physical. I asked him what had occurred to which he stated that they began “rolling around” and at one point “in order to stop him” Herrera put [VICTIM #1] into a headlock. He stated that the fight had resulted in [VICTIM #1]. receiving a small mark under his eye. I then went to speak with Mrs. [WITNESS #1].
Upon speaking with Mrs. [WITNESS #1], I asked her what had occurred to which she stated that she and Herrera had been arguing about the above mentioned fight which had occurred and upon trying to leave the residence, Herrera’s mother grabbed her by the arm and he put her into a headlock in order to try to keep her there to talk. She ended up pushing past and was able to exit the property. I asked her about the altercation between he and his son to which she stated that she did not observe the initial however did see them fighting. She stated that Herrera was the cause for the black eye which she believed was extensive.
I then went to speak with [VICTIM #1] who was inside with his grandmother (Herrera’s mother). Upon entering, I observed a dark bruise under his eye as well as a small laceration. [VICTIM #1] stated that he had gone to his room after an argument with his father and Herrera then followed him into the room. [VICTIM #1] stated that Herrera pushed him initially and as a result he and Herrera began fighting which resulted in his eye getting hurt.
Due to the bodily harm to [VICTIM #1] and admission of the altercation, I placed Mr. Herrera into custody for exceeding the scope of corporeal punishment under OCGA 16-5-23.
