On Monday, the 4th of May, 2026, at approximately 0144hrs, I (Sgt Kasmar) was patrolling the area of North Rome after hearing gunshots. I observed a suspicious vehicle at the dead end of Pearl St and went to investigate. There have been issues with people dealing drugs at the dead-end of Pearl St. I pulled behind a dark gray Ford Fusion with a temporary tag [REDACTED] to make consensual contact with the driver. None of my emergency equipment was activated at the time.

When I got behind the suspicious car, a male got out of the front right passenger seat, later identified as Walter Kirby (offender), I smelled the odor of marijuana coming off of him. I asked him for his ID, and he asked why I initially told him we were investigating gunshots in the area. He walked back to the car, and I smelled the odor of marijuana also coming from the car. I asked him if there was any marijuana in the car, and he told me that they were smoking it and he threw it out on the ground. I told him that since I could smell it coming from the car, I was allowed to search the car.

Once I told him I was searching the car, he became visibly nervous, asking why I was searching it and wanting to call his mother. There was a female in the driver’s seat, Derriyona Whately (mentioned/witness), and I had her step out of the car. I had another officer come stand by with them while I searched the vehicle. While walking to the passenger side, I located the half-smoked marijuana cigarette on the roadway where Mr. Kirby said he threw it and collected it as evidence. I started on the front right passenger side, and when I got under the passenger seat where Mr. Kirby was sitting, I located a tan Glock 19x 9mm serial # CDZK433 and ran it through dispatch to check if it was stolen. While dispatch was checking the pistols’ status, I searched the rest of the car and found nothing illegal.

Dispatch notified me that the pistol was stolen out of Gordon County. I went back to my patrol car to check if Mr. Kirby was a felon or prohibited person from owning or possessing a firearm, and he was a convicted felon. I collected the firearm as evidence, and I placed Mr. Kirby under arrest. He was transported to the Floyd County Jail and was booked in without incident.
