On August 6, 2026, at approximately 6:24pm, I was dispatched to [100 BLOCK] Pirklewood Circle for an incident of public indecency. The complainant, [VICTIM #1], stated that she was on her back porch playing peek-a-boo with her toddler when she felt like she was being watched. She looked at a house behind hers and saw a slender white male standing in the window mast*rbating. She told me that she could clearly see his genitalia and that he was mast*rbating fully nude. Further, she stated that the curtain was open as well as the actual window.
[VICTIM #1] stated that she immediately ran inside to get her phone to attempt to take photographs. She captured a photograph where the male was not fully visible in the window while he was attempting to close it. [VICTIM #1] believed that the subject was pleasuring himself to her daughter since there is a child swing in the back yard and believed that any person would have fully known that there was a child at her home because of it.
I confirmed the address of the house with a map, noting that it was the fourth home from the east side of Dog Path Trail and went to the residence of [100 BLOCK] Dog Path Trail. I met ANTHONY SMITH who stated that he and his wife regularly walk around his home naked when the kids are not around. He stated that his wife was watching TV and his two children were playing a game while he was upstairs. SMITH stated that he was getting ready to go to Good Ol’ Days to play pool with his friends but then changed his mind and was going to go out. Further, he stated that what might have appeared to be mast*rbation was him scratching or adjusting himself due to discomfort from a sexually transmitted disease. SMITH stated that he knew he had been seen by the complainant and that’s when he closed the window and curtains.
SMITH was taken into custody for Public Indecency in violation of OCGA 16-6-8. He was placed into handcuffs, checked for fit and double locked, and placed into the prisoner compartment for contraband prior to and after the SMITH occupying it, with nothing found. He was transported and released to Forsyth County Jail.
