On Monday March 31, 2025 I Deputy Ellington 522 was assigned to Gilmer Sheriff’s Office UPD. At 11:53 hours, I was dispatched a Domestic at [30 BLOCK] Lafayette Drive Ellijay, GA. Dispatch advised of the compliant hearing a gun shot, screaming, crying and possibly a dog shot. Deputies responded Code 3 emergency traffic (lights and siren) Unit #1524. Audio/video and body camera activated.
Sgt. Pim 553, Cpl. Carver 529, DFC Scott 532 and I arrived to [30 BLOCK] Lafayette Drive and were directed to [30 BLOCK] Lafayette Drive. I observed a male possibly in his 50s on the front porch, deputies ordered him to coming down the steps. The male Mr. Juan C. Cayro described that his fiancé was jealous of his deceased wife dogs and that his dog had bitten her. Mr. Cayro stated that he had shot the dog. Mr. Cayro stated that the fiancée (Ms. [WITNESS #1]) had left the scene with her daughter and her dogs. Mr. Cayro denied anyone else being in the residence. I requested permission to enter the home and he agreed. Cpl. Carver and I cleared the residence and observed no one there.
Mr. Cayro described Ms. [WITNESS #1] to be jealous of his deceased wife and anything about her. Mr. Cayro stated that she hated the dogs because they belong to his deceased wife. Mr. Cayro stated that Ms. [WITNESS #1] became upset when she went to feed the dogs (Dachshund Hounds). Mr. Cayro stated that Ms. [WITNESS #1] had been bitten by one of the older ones. Mr. Cayro described an argument and appeared to be upset and angry. Mr. Cayro stated that this dog had bite at people in the past. Mr. Cayro stated that he retrieved a 45 cal. pistol and shot the dog. Mr. Cayro stated that Ms. [WITNESS #1] became upset and her daughter [REDACTED BY AGENCY] heard the shot, ran outside, and there were screaming and crying. Mr. Cayro stated that Ms. [WITNESS #1] gathered her dogs and daughter and left the scene. Mr. Cayro was volunteered to call Ms. [WITNESS #1] and requested her to return. Mr. Cayro stated that Ms. [WITNESS #1] was on the way to her residence to drop off her dogs and would return.
While waiting on Ms. [WITNESS #1]; Mr. Cayro was further questioned and he walked the deputies through the incident. Mr. Cayro showed us the location where the shooting of the dog happen. This was outside the garage beside an older BMW car. Mr. Caryo showed where he was standing and the direction of the shooting. Deputies observed blood and what appeared to be brain matter on the concrete driveway. The residence of [30 BLOCK] Lafayette Drive was directly behind the location of the shot that had been fired. Mr. Cayro stated that Ms. [WITNESS #1] was upset about this and her daughter ran outside after hearing the gun shot and became crying. I asked Mr. Cayro if he felt he was angry at the time and may have escalated the situation. Mr. Cayro agreed stating the [REDACTED BY AGENCY] did not see the actual shooting, but did witness the deceased dog. Mr. Caryo strongly denied of any physical violence then admitted that there were some pushing and shoving, where Ms. [WITNESS #1] knocked his glasses off. Mr. Cayro stated that he had placed the 45 cal. Pistol back in his bedroom and placed the dead dog in a box. Deputies observed the box placed in the garage and a 45 ACP Cal. bullet on the front next to the entrance door. Deputy Scott located the empty 45 shell casing on the driveway in the area of the shooting. Photograph of the blood was taken from the exact location to where Mr. Cayro said he was standing at the time of the shooting.
Ms. [WITNESS #1] arrived and stated that she had gone the garage to feed the dogs when she got bitten. Ms. [WITNESS #1] showed her left leg and deputies observed abrasion to the leg similar to scratches as if being scratches by briars up and down her leg. Ms. [WITNESS #1] had one on the upper thigh that appeared a little deeper. There was no blood observed by deputies. Ms. [WITNESS #1] stated that she told Mr. Cayro and he became upset, saying he was going to shoot the dog. Ms. [WITNESS #1] stated that Mr. Cayro got a gun and shot the dog in the head and her daughter heard the shot and the argument. Ms. [WITNESS #1] stated that her daughter came outside and began crying. When asked were her daughter was Ms. [WITNESS #1] stated that she had left her at home.
The resident/witness of [30 BLOCK] Lafayette Drive Mrs. [WITNESS #2] stated that she heard the gun shot and screaming. She stated that she rushed onto her back porch and witnessed the little girl standing in front of Mr. Cayro crying. Mrs. [WITNESS #2] stated that her first instinct was to run to the little girl, and then she witnessed the little girl kneeling to the ground. Mrs. [WITNESS #2] stated that she then saw Mr. Cayro with a gun in his hands; she said that she thought that he had shot the girl’s mother. Mrs. [WITNESS #2] stated that she returned to her house and called for help. Mrs. [WITNESS #2] stated that there had been ongoing arguments that they had been hearing at between Ms. [WITNESS #1] and Mr. Cayro. Mrs. [WITNESS #2] stated that she went onto her front porch where she could hear them screaming and fighting. Mrs. [WITNESS #2] stated that she saw the little girl within the driveway crying and called her over. Mrs. [WITNESS #2] stated that she saw Mr. Cayro and Ms. [WITNESS #1] pushing and shoving each other. Mrs. [WITNESS #2] called the girl over and she said that he shot the dog in front of her I the head. Mrs. [WITNESS #2] stated that the little girl had blood splattered on her legs upward to her shorts. This interaction between Mrs. [WITNESS #2] and the girl was captured on the front porch Ring camera.
Mr. Cayro was arrested, hand cuffed in front, checked for fit, and double locked. Mr. Cayro was pat-down and escorted to the rear of Unit #1524 (rear seat camera activated). Mr. Cayro was transported and released to Gilmer Detention Staff without incident. A rear seat contraband check was completed with negative findings. Warrants are being applied for Reckless Conduct of a Firearm, Cruelty to Children, and Cruelty to Animals.
All parties were advised of the Georgia Vine website. Evidence bagged, tagged, and sealed. Ammo double bagged, pistol slide zipped tied open. evidence stored in Evidence box #10 at UPD.
