I arrived on scene and Cpl White and Deputy Jump had the male identified as Juan Cayro detained in handcuffs checked for proper fit and double locked. I walked over to the female that was still sitting in her car to see what was going on. The female was identified as [VICTIM #1]. Ms. [VICTIM #1] stated her and Mr. Cayro were out having drinks and dinner. She stated they were headed back to the house at [1500 BLOCK] Lower Tails Creek Rd so he could get his vehicle. She stated while driving back home, Mr. Cayro started accusing her of cheating. She stated he started hitting her, so she started hitting him to get him to stop. She stated they were able to safely make it home.

She stated once they were home Mr. Cayro got into her car and drove it down the road. She stated once he got back she noticed her car had been damaged on the front passenger side. She stated the neighbor came by on a 4-wheeler and was trying to ask her if she was okay. She stated he left and she was able to call 911.

I observed blood on her hands, and face. Her nose appeared to be swollen and was bleeding. I also observed a small cut on her upper lip. I did not see any marks on her hands. I walked to the passenger side of her car and observed heavy front end damage. Photos of the car have been added but no photos of the female due to her leaving in the ambulance and cleaned up before an pictures could be taken. All evidence of her condition is on body camera.

I walked up to where Deputy Jump and Mr. Cayro were standing and went to read Miranda due to him being in handcuffs. He stated you don’t have to read that I wont speak to you. I advised okay and went back to where the female was at sitting in her car. I advised her I would be taking Mr. Cayro to jail and asked if she was going to the hospital. She stated okay and that she would be going to the hospital.

I was gathering the rest of the information needed for the report and I was advised Mr. Cayro wanted to speak with me now. I walked back to him and read him his rights. He stated he would speak with me. I asked him what happened. He stated they were headed home and Ms. [VICTIM #1] was driving. He stated he told her he would not deal with cheating and she started hitting him. I asked what he did. He stated at first nothing.

I asked what happened when they got home. He stated he drove down the road a little ways and then came back. I asked if they hit anything on their drive home. He stated he did not think so. I asked if he hit something when he drove down the road. He stated he did not think so but he might have hit something in the roadway. He stated he got back to the house and she called 911 on him.

I observed a laceration (cut) on his right eye and swelling. I asked what happened. He stated it must have been when she hit him. I asked if it was closed or open fist. He stated closed. I looked at his hands and observed small cuts on his right hand. Photos of his injuries have been added.

Sgt. Blaylock was able to follow a trail of liquid from the home to where the vehicle was wrecked at [1800 BLOCK] Lower Tails Creek Rd. She stated it looks like he missed the curve and went up a downed tree on the side of the road before coming back onto the road and making it back to the house.

Deputy Jump was about to transport Mr. Cayro to the Gilmer county detention center when he decided he did want to go to the hospital. Deputy Jump transported him to the hospital and the female went by ambulance.

I also went up to the hospital to give Ms. [VICTIM #1] a copy of the victims notification. She refused to be notified. Deputy Jump stayed with the male. The male was treated at the hospital then transported to the Gilmer County Detention Center.

I was advised he had bond conditions where we was not allowed to be around Ms. [VICTIM #1].

He was arrested for aggravated Battery (FV), Leaving the scene of an accident, and Bond violation.
