Deputy Camp and I arrived on scene at the residence and observed a white picket fence that had been ran over. I walked up to a male identified as Robert Lewis. He stated a male by the name of Tyler Hagin showed up to the house and was causing a scene.
I asked Mr. Lewis to walk me through what happened from his point of view. Mr. Lewis was all over the place with his story at first and stated Tyler came over and kicked in a door. He stated that Tyler was cussing out the older couple that lived there. He said Tyler was backing out of the driveway, and Tyler flipped off Mr. Lewis. He stated thats when he pulled the trigger on his 44 magnum. He stated Tyler continued to back out of the driveway and hit the fence. Mr. Lewis stated that he did not know if he accidentally shot Tyler or not.
I asked why Tyler was there. Mr. Lewis stated that Tyler stole $80,000 dollars from the family. He stated that there was already a case on that incident. He stated that yesterday two males met up with Tyler to get the money back. He stated [REDACTED] and [REDACTED] beat up Tyler. He stated thats when Tyler gave half the money back.
I asked Mr. Lewis to walk me to the door that was kicked in. Mr. Lewis walked me into a room at the back of the house. He stated that Tyler was able to get into the room but kicked in the door to the main part of the house. I did not observe any damage to the door. I was advised the door does not lock and they use a dresser to keep it closed.
I was met by the older couple identified as [WITNESS #1] and [WITNESS #2]. [WITNESS #2] stated that Tyler came over to get his stuff. He stated that Tyler kicked in the door and was yelling about where his stuff was. [WITNESS #2] stated he told Tyler it was around front under the carport. He stated thats when Tyler went out the door.
I asked Mr. Lewis to tell me what happened from that point. He stated he heard the arguing and went inside and got his gun from the house. He stated he was walking back down to the house when Tyler was backing out of the driveway. He stated that Tyler flipped him off and thats when he shot the truck. He stated Tyler left after that.
I gathered everyones information and Deputy Camp took photos of the scene. We collected the gun for evidence. I called Deputy Knight who was out with Tyler at the Gilmer County Detention Center. I asked for Tyler’s side of the story. I was advised that Tyler went there to get his stuff and when he was trying to leave his truck was shot. I was advised Tyler was scared and hit the fence after the truck had been hit. I asked where the bullet hole was. I was advised right behind the driver door.
I called the on call detective Dan Farnham and advised him of the incident. He stated to collect the gun and truck. I advised I would do so.
Deputy Camp and I placed Mr. Lewis under arrest for aggravated assault. We placed him in handcuffs behind the back, checked for proper fit and double locked them. Deputy Camp transported Mr. Lewis to the Gilmer County Detention Center. I went to the Jail to speak with Tyler.
I advised Tyler of what was going on and advised a detective would call him tomorrow to pick up his truck. Sgt. Robinson took photos of the truck and we had it moved into the secure lot located next to the jail. Tyler stated he understood and was just thankful the bullet did not hit him.
