On August 29th, 2022, I, Deputy Clayton Hughes #520 respnded to [60 BLOCK] Monet Dr in reference to an assault. Dispatch advised the that two of the parties involved in the assualt left the residence. I responded Code One (No activated emergency lights or sirens).
Upon my arrival I met with the complainant in the driveway of the residence. I identified the complainant as [VICTIM #1]. [VICTIM #1] stated his brother (identified as William Carter) and nephew (Identified as Carson Carter) came into his residence and stated demanding that he give them his father’s living will. [VICTIM #1] stated his father was currently in the hospital and wasn’t expected to live much longer. [VICTIM #1] stated he told William that he did not know where the living will was. [VICTIM #1] stated thats when his brother became angry and started accusing [VICTIM #1] of lying.
[VICTIM #1] stated he told his brother to shut his mouth while screaming at him. [VICTIM #1] stated that is when William put him in a headlock and began punching him in the face. [VICTIM #1] stated he broke free from William and went to run downstairs. [VICTIM #1] stated that is when Carson punched him in the side of the head. [VICTIM #1] stated he then went downstairs and locked himself in the basement until William and Carson left. I observed [VICTIM #1] to have both of his eyes swollen and bruised. [VICTIM #1] also complained of a rib injury as well. EMS arrived on scene shortly after to evaluate [VICTIM #1]. [VICTIM #1] stated he did not wish to go to the hospital.
I then spoke [VICTIM #1]’s wife, [WITNESS #1]. [WITNESS #1] stated she was downstairs when the incident occurred. [WITNESS #1] stated her children [REDACTED BY AGENCY] and [REDACTED BY AGENCY] were upstairs when the fight happened. [WITNESS #1] stated her daughter [REDACTED BY AGENCY] screamed that they were fighting upstairs. [WITNESS #1] stated that is when she went upstairs and began to tell William and Carson to stop and to leave the residence. After gathering all testimony and seeing [VICTIM #1]’s injury I will be charging William and Carson with the following charges:
OCGA: 16-5-23.1 Battery (Family Violence)
OCGA; 16-5-70(D)(2) Cruelty to Children in the third degree
Prior to leaving the scene a victims notification and victims pamphlet was completed and given to [VICTIM #1].
