On Monday, May 25th, 2026, at approximately 02:45 hours, I, Deputy First Class J. Ledford #544 of the Gilmer County Sheriff’s Office was notified by DFC C. Jump #545 there was an accident reported to him by the Coosawattee Central Office in the area of Creekside Trail. I responded code 1, (non-emergency).

Upon my arrival, I observed a black, Mercedes-Benz SUV in the ditch, a few hundred feet from the intersection of Creekside Trail and Beaver Lake Drive (on creekside trail). I then made contact with a female (Identified as: Zhu He), I asked Ms. He what happened, and she stated that she was driving on Creekside Trail (West bound), and met a car traveling east-bound, and it caused her to run out of the roadway and into the ditch.

I observed that Ms. He’s eyes were bloodshot, and she was speaking slowly. I asked Ms. He where she was coming from, and she stated that she had went to see a friend in Suwannee, Georgia. I then began speaking to DFC Jump, and watching Ms. He as she paced back and forth, and noticed she was continuously tripping and almost falling.

Once I re-approached Ms. He, I asked her if she had been drinking, and she stated that she had not, and she was at work. I then mentioned that she stated earlier that she was visiting a friend, and she stated that she went to work, and then went to visit a friend. I then smelled the odor of alcoholic beverage coming from Ms. He’s person as she was speaking to me.

It was at this moment that I asked Ms. He to walk with me to the front of DFC Jumps’ patrol unit (unit #425), where I explained that I would like to conduct Standardized Field Sobriety Testing, to ensure that she was safe to drive, she complied. I then had her stand with her feet together, arms to her side, and focus on the tip of my finger. Before I began Horizontal Gaze Nystagmus, I asked Ms. He if she had any history of Traumatic Brain Injury, back injury, spine injury, or any diagnosis with her eyes, and she stated she did not. I then began my Standardized Field Sobriety testing, below are my findings:

Conditions:

Weather: Cloudy, 67 degrees.
Surface: Pavement, wet, HGN on incline, rest of observations were unable to be conducted due to the degree of incline.
Attire: White shirt, black jeans, grey shoes.

Horizontal Gaze Nystagmus (HGN) (3 possible clues each eye for total of 6)
Eyes: Bloodshot.
Glasses / contacts: No
Color: Brown
Equal pupil size: present
Resting Nystagmus: none

Equal tracking in both eyes: present
Lack of smooth pursuit in both eyes: present
Distinct and sustained Nystagmus at maximum deviation in both eyes: present
Onset of Nystagmus prior to forty-five degrees in both eyes: Present
Vertical Nystagmus in both eyes: not present
6 out of 6 clues observed, evaluation had to be restarted multiple times, due to Ms. He moving her head, and looking away from the tip of my finger.

Walk and Turn (8 possible clues)

• Could not be completed, due to level of incline on roadway.

One Leg Stand

• Could not be completed, due to level of incline on roadway.

I then asked Ms. He if she would be willing to give a Preliminary Breath Test, to which she agreed, and it detected a positive presence of alcohol, she then asked for a second attempt, and it again detected a positive presence of alcohol.

I then advised Ms. He to place her hands behind her back, and handcuffed her behind her back, checked the cuffs for fit, and then double locked. I advised Ms. He that she was under arrest for Driving Under The Influence of Alcohol. I read Ms. He the Georgia Implied Consent Notice at approximately 03:05 hours, to which she agreed to the State Administered Chemical Test of her breath.

Deputy Jump conducted an inventory of the vehicle, and stood-by until next list (on call) wrecker service, Bears Towing, arrived to remove the vehicle. I transported Ms. He to the Gilmer County Adult Detention Center, where she was turned over to Detention Staff without incident. Deputy J. Parks #531 met me at the Detention Center and conducted the State Administered Chemical Test of her Breath, which showed a result of 0.202%.

Ms. He has been charged with the following:

O.C.G.A. 40-6-391 – Driving Under the Influence of Alcohol – Based on the clues I observed during the SFST portion. Citation #62-118

A DDS 1205 form was filled out and submitted, I explained the instructions for an appeal hearing, and provided her a temporary permit.

Prior to leaving the Gilmer County Detention, a rear seat contraband was conducted with negative findings.
