DRIVING UNDER THE INFLUENCE OF DRUGS

Officer’s Narrative:

On 7-16-2022 at 1416 hours, I was dispatched to [100 BLOCK] Joann Drive (Glynn County) in reference to a crash. On my arrival I observed that a White Cadillac Deville had struck the rear of a White Chevrolet express van (See crash # C000830281 for more details).

I made contact with the at fault driver Belinda Moon. I asked her what happened. She stated that she was driving and missed her road. She stated that at the same time her small child and puppy started crying in the back seat area. She stated that she turned around to see about the child and must have run off the road and struck the van.

It should be noted that while talking with Ms. Moon she was very fidgety and animated in her motions. She had bloodshot eyes, and her emotions would cycle from angry, crying, polite and talkative. I asked her when the last time she consumed any prescription medication or drugs.

Ms. Moon stated that the only thing she had taken was ibuprofen and could not remember if she had taken her muscle relaxer this morning. I asked what type of muscle relaxer she took and she stated “[REDACTED BY AGENCY]” She also told me that she uses a CBD vape pen and did use if today.

I asked her if she was consent to the Standardized Field Sobriety testing. She did consent. Ms. Moon was medically cleared and stated that she was not diabetic and did not have any injuries. I observed 4/6 clues on the Horizontal Gaze Nystagmus test. Ms. Moon would stop following the stimuli and move her head several times.

I observed 5/8 clues on the Walk and Turn test. Ms. Moon was unable to maintain her balance during the instructional stage. She missed heel to toe, stepped offline, made an improper turn and raised her arms for balance.

I observed 3/4 clues on the One Leg Stand Test. Ms. Moon swayed her body, raised her arms for balance and put her foot down.

During the Modified Romberg Balance, Ms. Moon estimated the passing of 30 seconds in 14 seconds. Ms. Moon also had exhibited a circular sway and eyelid tremors. Ms. Moon also had the marked reddening of the conjunctiva and the lack of convergence in her left eye.

I advised her that she was under arrest for DUI. I read her Georgia’s Implied Consent Notice and requested a blood test. She stated that she wanted to speak with an attorney. Ms. Moons answer was taken as a nonverbal refusal.

Tiger Towing responded for Ms. Moon’s vehicle. I transported her to the Glynn County Jail without incident.

I charged her with

1.) DUI
(2) Failure to maintain lane and
(3) Endangering child under 14 while DUI.

Ms. Moon was released into the custody of the jail staff.
