On the above date I was dispatched a person with a gun call. While I was en route I was informed by dispatch that the caller was a taxi driver and a passenger had spit on him and then pulled and pointed a gun at him. I was informed that the incident had taken place at the intersection of L St and Gordon St. I responded to the intersection of Norwich St and L St to meet with the caller who had relocated to this area due to being in fear for his safety. The caller who was identified as Mr. [VICTIM #1] was sitting inside of his van and was visibly upset.
Mr. [VICTIM #1] informed me that he received a call for a ride from a male that was later identified as Timothy Wallace who needed to be picked up from [2200 BLOCK] Gordon St. Mr. [VICTIM #1] arrived he got the feeling that Mr. [VICTIM #1] was “trouble” and requested that he pay prior to receiving a ride, Which is when Mr. Wallace is said to become aggressive stating that he had money and then spit on Mr. [VICTIM #1]. Mr. [VICTIM #1] stated that Mr. Wallace then pulled a gun and pointed it at Mr. [VICTIM #1] stating “Pu*sy a*s Ni*gah wish you would Stop” When Mr. [VICTIM #1] was trying to call 911 to inform police of what had taken place. Mr. [VICTIM #1] described Mr. Wallace as a light skinned black male wearing a black shirt, Blue pants, with a afro. I provided this information to other officers via radio.
I was informed by Sgt. Geisbers that she observed a male matching the description that was provided near the same location. Sgt Geisbers observed the male walk behind an abandoned house and then appear on the front porch of the same house. I was informed that when they made contact with the male he identified himself as Timothy Wallace. Upon making contact with the male a crowd of people began to form and cause a scene. Mr. Wallace was positively identified by Mr. [VICTIM #1] and placed under arrest. Upon search of his person incident to arrest 5 38 Special rounds were recovered on his person, along with a ski mask.
I read Mr. Wallace Miranda rights and he stated he did not wish to talk to me about the incident. Mr. Wallace was transported to CDC and charged with the following:
Aggravated Assault- 16-5-21(a)2)) A person commits the offense of aggravated assault when he or she assaults: With a deadly weapon or with any object, device, or instrument which, when used offensively against a person, is likely to or actually does result in serious bodily injury; Mr. Wallace pointed a handgun from his he pulled from his waist band at Mr. [VICTIM #1]
Disorderly Conduct- 16-11-39(a)1)) A person commits the offense of disorderly conduct when such person commits any of the following: Acts in a violent or tumultuous manner toward another person whereby such person is placed in reasonable fear of the safety of such person’s life, limb, or health; Mr. Wallace became irate with Mr. [VICTIM #1] when asked to pay prior to receiving a ride and spit on Mr. [VICTIM #1] before pulling and pointing a firearm on a public street
Simple Battery- 16-5-23 A person commits the offense of simple battery when he or she either intentionally makes physical contact of an insulting or provoking nature with the person of another; Mr. Wallace Spit On Mr. [VICTIM #1] after being asked to pay his fare for a taxi ride
