On September 4, 2022, at approximately 0014 hours, I, Trooper McCrary was behind a vehicle on Mall Boulevard, waiting at the stop sign at Scranton Road. I observed a black Kia Sorento fail to yield while turning left and pulled directly out in front of another vehicle while turning left onto Scranton Road.

I performed a traffic stop on that vehicle on Scranton Road at its intersection with Georgia 25 Spur. I approached the vehicle at the passengers window and began speaking with the driver, who was identified as Victoria Todd. I could instantly smell the odor of an alcoholic beverage coming from the passenger area of the vehicle. I observed that Mrs. Todd had bloodshot red and watery eyes, and spoke with slow and slurred speech.

I asked Mrs. Todd to step out of the vehicle and to stand in front of my vehicle. While Mrs. Todd was walking to the front of my vehicle, she was unsteady on her feet. I asked Mrs. Todd how much alcohol she had drank and she stated 2 beer and 2 shots. I asked Mrs. Todd if she would be willing to perform field sobriety testing to be sure that she was safe to drive and she refused.
I asked her a sample of her breath via PBT and she refused.

I placed Mrs. Todd under arrest and read her Georgia’s Implied Consent Notice for Suspects Age 21 or Over for blood and she refused. The vehicle was released to [REDACTED] at the owner’s request. I transported Mrs. Todd to the Glynn County Detention Center. When I opened the back door of my patrol vehicle, Mrs. Todd was asleep and I had to shake her knee and call her name over the course of a few minutes to wake her. Mrs. Todd was turned over to jail staff for booking. This scene was digitally recorded in patrol vehicle 722.
