On 03/02/2026 at 1815 hours I responded to [REDACTED BY AGENCY] Highway 53 E (Marathon Gas Station) in reference to a verbal fight in progress.

As I was in route, dispatch advised the altercation was between the cashier of the gas station and a Hispanic male wearing a white shirt. Dispatch also advised the male was possibly intoxicated.

Upon my arrival, I met with Sgt Thompson who arrived on scene just a few minutes prior to my arrival. Sgt. Thompson advised the Hispanic male (later identified as [REDACTED BY AGENCY] Flores) was acting disorderly inside of the gas station and was intoxicated. [REDACTED BY AGENCY] was standing beside Sgt Thompson as I was speaking to him, and I detected a strong odor of alcoholic beverage emitting from his person. I also observed his eyes to be bloodshot red and watery.

I then spoke with the cashier of the Marathon, [REDACTED BY AGENCY] [VICTIM #1]. Mr. [VICTIM #1] advised to me [REDACTED BY AGENCY] entered the store approximately 30 minutes before my arrival and attempted to buy beer. Mr. [VICTIM #1] advised when [REDACTED BY AGENCY] card declined due to insufficient funds, he took the beer away from [REDACTED BY AGENCY].

Mr. [VICTIM #1] advised [REDACTED BY AGENCY] then became irate and started punching merchandise on the counter while yelling “I’m going to fu*k you up.”. Mr. [VICTIM #1] advised [REDACTED BY AGENCY] actions and statements lead him to believe he was going to receive bolding harm or injury from [REDACTED BY AGENCY]. Mr. [VICTIM #1] also advised he wished to press charged against [REDACTED BY AGENCY].

I then spoke to Sgt. Thompson once more and advised two witnesses, [REDACTED BY AGENCY] [WITNESS #1] and [REDACTED BY AGENCY] [WITNESS #2], both observed the incident and has corresponding accounts of the incident. Both witnesses advised they observed [REDACTED BY AGENCY] punch merchandise inside of the store while yelling toward the cashier and threatening the cashier.

At 1825 hours I placed [REDACTED BY AGENCY] under arrest. As I was attempting to place [REDACTED BY AGENCY] into handcuffs, [REDACTED BY AGENCY] tensed up his arms and attempted to bring his arms toward his body to resist being put into cuffs. I then transported [REDACTED BY AGENCY] to the Gordon County Jail without further incident.

State Warrants for Simple Assault, Disorderly Conduct, Public Drunkenness, and Obstruction/Hindering Officer have been applied for.
