On 03/25/2023 at approximately 1626 hours, while I was in Walmart located at 450 W Belmont. I was flagged down at the self checkout by a Walmart employee, [VICTIM #1]. [VICTIM #1] stated a customer, later identified as Maryann Brenner attempted to purchase groceries however her card declined.

[VICTIM #1] stated this has been an ongoing issue with Maryann over the last week. [VICTIM #1] stated Maryann then made verbal threats to [VICTIM #1] stating she would climb over the counter and kill her. I inquired with [VICTIM #1] on whether or not she wished to press charges. [VICTIM #1] stated she did wish to press charges on Maryann for the threats she made.

I then advised dispatch of my location and the reason for the flag down. I then approached Maryann in order to further investigate the incident occurred between her and [VICTIM #1]. I introduced myself to Maryann and advised her of who I am and who I work for.

Maryann then stated “she made threats first”. I asked Maryann what threats were made. Due to the irate response of Maryann, a customer requested Maryann and I relocate due to his child being present. I advised Maryann to step to the customer service desk so we could speak about the incident. Maryann refused.

A Walmart manager then retrieved the cart of unpaid groceries from Maryann. Maryann stated she was using that to walk due to her not having her walking cane. I advised Maryann I would be willing to hold her hand as we walked to customer service to better assist her. Maryann refused again.

I instructed Maryann that we needed to walk to customer service to speak in order for customers to enter and exit self checkout efficiently. Maryann refused and stated she was not going anywhere. At this time Maryann sat on the self checkout counter and stated she would not move.

I advised Maryann that this was obstruction and that she would be charged with this. Maryann continued to refuse to comply. I then attempted to place hand restraints on Maryann for obstruction. I placed the hand restraints on Maryann’s right wrist and attempted to place the second restraint on Maryann’s left wrist.

Maryann then began to scream and threw herself on the ground. I instructed Maryann to stop resisting and I attempted to restrain Maryann’s second arm. Maryann continued to resist and scream and did not allow me in placing the restraints on her. I then unholstered my taser and pressed the arc switch in hopes of gaining compliance with Maryann, which was unsuccessful.

At no time was the taser deployed or contact was made with Maryann. Maryann continued to resist and still did not allow me to restrain her. I attempted to pick up Maryann in order to relocate to a safer environment for Maryann and myself due to the large amount of customers surrounding us.

At this time other officers arrived on scene and assisted in picking up Maryann and effectively restraining her. The hand restraints were checked for fit and double locked. Maryann was escorted to the Loss Prevention office.

I then spoke with another employee, [WITNESS #1] who stated witnessed the entire incident between [VICTIM #1] and Maryann. [VICTIM #1] and [WITNESS #1] both provided victim/witness statements on the incident that occurred.

Maryann was placed in the cleared rear of my patrol vehicle. Maryann was escorted to the Gordon County Jail where custody was exchanged with jail staff without further incident. Warrants were obtained on Maryann for Terroristic Threats and Acts and Obstruction.
