On May 13, 2025, I Deputy Jenkins, responded code 3 to a shots fired call in the area of Old Historic 441, and Sanders Street. Due to the caller’s statements that they had heard multiple gunshots near old historic 441, and yelling coming from the residence nearby, it was believed that there was a possible domestic progress. The caller stated that they believed it to be coming from Chad Dyer’s house.

While en route, Clarkesville PD unit 305 called Sgt Ivester via SO dispatch, stating that he was in the area and could be en route if requested. Due to myself and Sgt Ivester responding from the south end of the county, it was requested that Clarkesville be en route.

Upon our arrival at what we believed to be Mr. Dyer’s residence, we observed a grey Ram 1500 in the driveway bearing tag # [REDACTED]. It was determined that we were at the Dyer residence, when the tag returned to the registered owner [WITNESS #1], Chad’s daughter. Upon entering the open garage, we observed an open door on the left side of the garage, through which Chad Dyer was visible, sitting in the recliner on the opposite side of the room. I also noticed a loaded double barrel shotgun laying across the back of the couch in the middle of the room with the action open. Upon seeing myself and Sgt Ivester, Chad became immediately agitated, yelling with slurred speech that we could not come inside without a warrant, and had to leave the property. Sgt Ivester attempted to explain to Chad why we were here multiple times and asked if he had been shooting. Chad began to yell that it was his right to be able to shoot his guns. I responded that his second amendment rights were to keep and bear arms, not to shoot whenever and wherever he wanted. Chad was getting increasingly irate, and stood up out of the recliner. I asked Chad multiple times to sit back down so I could explain the situation. Chad then, with fists clenched and an aggressive posture, approached in my direction and the direction of the loaded shotgun.

At this point, due to officer safety, I entered the residence and took the firearm out of Chad’s reach, handing it to Sgt Ivester behind me, who placed it on the table near the door. Chad then became extremely irate and verbally aggressive, shouting profanities, and telling us to get out of his house. While this was happening, Chad’s daughter [WITNESS #1] was sitting on the other couch in the room, attempting to calm down her father. Chad’s father had also entered the room, carrying what appeared to be a large flashlight. When getting within close proximity to Chad, it was immediately apparent that he was under the influence of alcohol, due to the slurred speech, the stumbling manner in which he walked, and the odor of alcohol emitting from his person. After it was apparent that Chad was not going to cooperate, and continued to be belligerent, Chad Dyer was placed under arrest for, Discharge of a Firearm while Under the Influence of Alcohol Disorderly Conduct

At this point I placed my hands on Chad’s left arm in an attempt to place him in handcuffs. Chad then began to pull away. Chad was then placed on the ground, where he continued to resist, trying to pull his hands away from the Deputies holding them in an attempt to avoid being placed in handcuffs. After finally being able to place both hands into the cuffs, they were double locked, and Chad was escorted to my patrol vehicle. After arriving at my patrol vehicle, Chad was searched incident to the arrest, and no contraband was located. I then opened the rear passenger door of my patrol car to place Chad inside. Chad refused to sit down and would not get into the patrol car. After being forced into the car, Chad was seat belted in for his safety. Chad then placed his foot outside the vehicle so I could not shut the door. I placed Chad’s foot back inside the vehicle. Chad again placed his foot back outside the vehicle. I grabbed Chad’s foot and placed it back into the vehicle. This process was repeated multiple times. Finally, Deputy Askey pushed Chad and his foot farther into the vehicle, and I was able to shut the door. Chad continued to pull and struggle against the handcuffs. I then went back to the residence, where Chad’s daughter had retrieved the handgun that she stated he had been firing. A picture of the serial number is attached. Chad was then transported to the Habersham County Detention Center, where he was turned over to jail staff. When removed from the vehicle, Chad called me multiple derogatory names, and stated that if the handcuffs weren’t on, he would “beat my a*s”.

When the handcuffs were removed at the jail, Chad wrists were bleeding due to him struggling and pulling against them despite being double locked. Chad also received a small cut to his left cheek. Pictures were taken and attached to the report. A use of force was completed and attached to the report.

Warrants were taken for;
Discharge of a Firearm While Under the Influence
