On 08/21/2026 at around 19:58 P.M. I Deputy Crawford was patrolling the area of GA 15 and Antioch Church Rd. when I observed a vehicle come off of Antioch Church Rd. from the Clarkesville side entering GA 15. The lane there is a right turn only lane with signage posted. I observed the Gray in color Ford fusion turn right onto GA 15 before crossing the median divider and cross through the gore to turn back onto the NB side of the divided highway.

I got behind the vehicle and conducted a traffic stop for the violation. I met with the driver who was identified as Jacob Kyle Chastain by his Georgia license. Chastain immediately apologized for his mistake. Chastain advised that he had been at work for 14 hours and he was just ready to get home. I asked Chastain if the address on Antioch Church Rd. was still a good address and he said yes. I confirmed with him that he was not in fact going home. Chastain changed up and said that he was in fact coming from his house.

Once again I asked Chastain where he was headed to and he said “nowhere”. Chastain then came up with the story that he was just nervous and that he was coming from his house and going to get some BBQ. While speaking with Chastain I noticed that he was overly nervous and was constantly moving while speaking very quickly. Chastain also had bloodshot and watery eyes. I returned to my patrol vehicle and attached Chastains license and requested an additional unit.

I returned to Chastain and asked him to exit his vehicle. I explained to him that I was noticing signs of possible impairment and wanted to ensure that he was safe to drive. Chastain advised that he did not trust law enforcement and had called his grandmother to come and stand by while the investigation was being conducted. I confirmed with Chastain that he would be willing to complete field sobriety evaluations pending his grandmothers arrival. He agreed. Upon the arrival of his grandmother I began with the Horizontal Gaze Nystagmus test. Chastain was medically cleared and I explained the instructions for the test. Chastain indicated that he understood. The following was observed.

• Equal tracking & equal pupil size (both eyes)
• Lack of smooth pursuit (both eyes)

The walk and turn test was not completed because Chastain advised that he had a bad knee. I then checked for lack of convergence which was present. I then asked Chastain to complete the One Leg Stand test. I explained the instructions to Chastain and he indicated that he understood. The following was observed.

• Put foot down
• Raised arms for balance
• Sways while balancing
• Chastain did not keep his arms by his side as instructed
• Chastain did not look at the top of his elevated foot while counting as instructed
• Chastain’s count was at 18 seconds when 30 actual seconds had passed

I then asked Chastain to complete the Modified Romberg test. I explained the instructions and Chastain indicated that he understood. Chastain estimated the passage of 30 seconds when 38 actual seconds had passed. While Chastain was counting I could smell the odor of an alcoholic beverage emitting from his person. I asked Chastain how much he had to drink that day and he shook his head before looking left and rubbing his fingers before replying with “not since yesterday morning”. The physical manifestations he presented with before answering that question are behaviors consistent among people who are not telling the truth when answering a question.

I then asked Chastain if he takes any medications. Chastain advised that he takes medication for depression. Chastain also advised that he had consumed 10 ml of liquid cough medicine about 5 to 10 minutes prior to the stop. I then asked Chastain to complete a PBT which showed a positive indication for the presence of alcohol (.21). I spoke with Sgt. Young who was the backup officer and advised him of my findings on HGN and what the PBT reading was and that the findings on the HGN test were not consistant with the reading on the PBT.

I asked Sgt. Young to confirm my findings on the HGN test. Sgt. Young completed the HGN test. I then asked Chastain to complete the Modified Romberg test once again. Chastains count was at 30 seconds when 39 actual seconds had passed. I had Chastain complete a PBT once again.

Due to the totality of the circumstances I determined that Chastain was impaired and less safe to drive. I placed Chastain into handcuffs and advised him that he was under arrest for DUI. Chastain was searched and he was read implied consent for drivers age 21 and over requesting a blood test. Chastain verbally agreed to testing. Chastain was secured into the rear of my patrol vehicle. Chastain’s vehicle was searched and I located 5 open containers of alcohol. There were four lokos as well as beat box wine bottles. Some of the containers were completely empty and some had about 1/4 of the contents left.

The vehicle was turned over to Chastain’s grandmother and I transported Chastain to the Habersham County Jail where I conducted a blood draw in accordance with policy and training. Upon the completion of the blood draw Chastain was turned over to the jail staff without further incident and all evidence was sealed and secured into the proper evidence locker. The rear seat of my patrol vehicle was cleared and I returned to service.
