Ryan Smith was stopped by Demorest PD Officer Baker 508 for speeding on Central Ave at an estimated 60–70 mph in a 25 mph zone while operating a Harley-Davidson motorcycle.

Sgt. Young arrived on scene of the traffic stop to assist.

Sgt. Young made contact with the driver identified by Georgia drivers license as Ryan Smith. Ryan Smith displayed watery eyes and emitted a strong odor of an alcoholic beverage.

Ryan Smith agreed to standardized field sobriety tests. Sgt. Young began with the HGN portion of SFSTs. Ryan indicated that he did not have any current medical conditions that would effect his head. Ryan was observed with equal pupils size and without a resting nystagmus. Ryan displayed 2 out of 2 clues for lack of smooth pursuit. Ryan displayed 2 out of 2 clues for distinct and sustained nystagmus at maximum deviation. Ryan displayed 2 out of 2 clues for nystagmus prior to the onset of 45 degrees. Sgt. Young did not observe vertical gaze nystagmus.

Ryan Smith was talkative but spoke with slurred, thick speech. He admitted to having some beer and Jack Daniels whiskey. He did not complete the walk-and-turn or one-leg stand due to prior medical conditions cited. Ryan Smith explained that he did not want to drive anymore and that he would have someone take him home.

Ryan Smith advised he knew the English alphabet. He was asked to recite the English alphabet beginning with the letter C and ending with the letter Q. Ryan Smith failed to follow instructions on the first attempt and began on the letter C and ended on the letter Z.

Ryan Smith advised that he had too much to drink and asked not to go to jail.

Based on the totality of the circumstances, Sgt. Young advised Ryan Smith that he was under arrest for DUI. Ryan was placed into handcuffs, checked for proper fit and double locked. Ryan Smith was read the Georgia Implied Consent Notice for suspects 21 years and older. Ryan Smith refused the state-administered chemical test of a blood draw. Ryan’s Harley Davidson motorcycle was turned over to his employer who was on scene, per Ryan’s request.

Upon arrival to the jail, Ryan was served with a search warrant for his blood sample. The blood draw was conducted by Sgt. Young who is a qualified person to conduct phlebotomy. The GBI blood toxicology kit was sealed and submitted into evidence for testing.
