On 7/6/2026 I, Ofc M Womack 2126, responded to a disturbance regarding a male subject loitering and disturbing the tranquility of peace at the Sunoco gas station taking place at the 378 Highway 155 S, which is located in McDonough Henry County GA. Upon my arrival, on scene, I observed a male subject loitering outside of the business later identified Garret Flakes [REDACTED BY AGENCY], who the complainant also advised was the male subject that was loitering in front of the business.
Upon making contact with the male subject I immediately noticed the smell of alcoholemitting from his person. I also noticed Mr. Flakes had a bottle of alcohol of what appeared to be an alcoholic beverage in his left pocket. Mr. Flakes had blood shot red eyes and difficulty standing upright. With all evidence of severe intoxication considered Mr. Flakes also struggled to articulate sentences displayed repetitive patterns of slurred speech. Due to numerous clues of intoxication, I asked Mr. Flakes how much he had to drink today. Mr. Flakes admitted to me that he had 3 beat boxes which are containers of alcoholic beverages.
With Mr. Flakes being severely intoxicated in public I informed Mr. Flakes that he was under arrest for public intoxication disorderly conduct which is a city ordinance within the City of McDonough. I placed Mr. Flakes in handcuffs behind his back double locked and checked for fit. Next I escorted Mr. Flakes to the rear exterior of my patrol car where I conducted a intrusive search of his person for weapons and other contraband.
While conducting my search, I located an open container of a pink alcoholic beverage in his left pocket. The open container appeared to have been consumed. It should be noted that the manager at Sunoco gas station alleged he witnessed Mr. Flakes take the bottle from the store. Due to no camera footage Mr. Flakes was not charged with shoplifting however after asking Mr. Flakes where he got the bottle, he informed he purchased it from a store on the west side of town. Mr. Flakes was also not able to provide a receipt.
Next I placed Mr. Flakes in the rear of my patrol car and transported him to the Henry County Jail. It should also be noted during the booking process, jail staff asked how much he had to drink. Mr. Flakes aloud stated he had 3 beat boxes, this time adding that he’d also had some wine. Mr. Flakes was released to the Henry County Jail on copies of citation. A back seat check was logged through dispatch for unit 41.
